BOARD OF AUCTIONEERS MINUTES

Legislative Office Building Room 307, Concord, NH

April 4, 2011, 9:00 a.m.

 

1.         The Board of Auctioneers convened at 9:00 a.m. with Chairperson Frank L. Eaton, Vice-Chairperson Jay T. St. Jean, Secretary Richard C. Berman, and Member Russell R. Abbott present.

 

2.         The Board on motion of Jay T. St. Jean, seconded by Frank L. Eaton, accepted the minutes of the March 7, 2011 meeting.

 

3.         The Board on motion of Richard C. Berman, seconded by Russell R. Abbott, and with Jay T. St. Jean abstaining, authorized the application of Joseph F. Collins for an Auctioneers License.

 

4.         The Board on motion of Jay T. St. Jean, seconded by Richard C. Berman, voted to table the application of Arthur A. Crisafulli Jr. for an Auctioneers License.  The Board is requesting a certified police record.

 

5.         The Board on motion of Jay T. St. Jean, seconded by Richard C. Berman, authorized the application of Melissa S. Karstedt for an Auctioneers License.

 

6.         The Board on motion of Jay T. St. Jean, seconded by Richard C. Berman, and further on a roll call vote as follows: Frank L. Eaton – yes, Jay T. St. Jean – yes, Richard C. Berman – yes, and Russell R. Abbott – yes, voted to go into non-public session to discuss matters under RSA 91-A, specifically, matters which would likely adversely affect the privacy of individuals and or matters in which litigation has been threatened against the Board.

 

7.         The Board on motion of Jay T. St. Jean, seconded by Russell R. Abbott voted to come out of non-public session.

 

8.         Based on the findings of an investigation by Jay T. St. Jean, the Board found no evidence to merit a hearing on the complaint made by Joseph Shelton.  The Board on motion of Russell R. Abbott, seconded by Richard C. Berman, voted to dismiss the complaint.

 

9.         The Board on motion of Russell R. Abbott, seconded by Richard C. Berman, voted to table the complaint made by Howard J. Guyotte, for further investigation.

 

10.       The Board on motion of Jay T. St. Jean, seconded by Russell R. Abbott voted to appoint an investigator for the complaint made by Steven Barill. 

 

            The Board on motion of Jay T. St. Jean, seconded by Richard C. Berman voted to appoint Russell R. Abbott as investigator for the complaint made by Steven Barill.

 

11.       Further Business:

 

A.    On March 7, 2011, the Board voted to hold a hearing on the complaint made by Elliott Morehardt.  Today, after further discussion, the Board found no evidence to merit a hearing.  The Board on motion of Richard C. Berman, seconded by Russell R. Abbott, voted to dismiss the complaint.

 

B.      The Board on motion of Jay T. St. Jean, seconded by Russell R. Abbott, voted to send Notice of Hearing in the matter of Charles Cobb, a complaint made by Londa Lee Jericho.  The Hearing will be held on May 2, 2011 at 9:15 a.m. in Room 307 of the Legislative Office Building, Concord, NH.

 

C.     The Board on motion of Richard C. Berman, seconded by Jay T. St. Jean voted to send a friendly reminder to Auctioneer Thomas Troon regarding the definition of Absolute Auctions, and setting reserves.

 

12.       The Board on motion of Richard C. Berman seconded by Russell R. Abbott voted to adjourn the meeting.
