BOARD OF AUCTIONEERS MINUTES

Legislative Office Building Room 307, Concord, NH

December 7, 2009 9:00 a.m.

 

1.             The Board of Auctioneers convened at 9:00 a.m. with Chairperson Richard C. Berman, Vice-Chairperson Jay T. St. Jean, Member Devin E. Moisan, and Member Frank L. Eaton present.  Secretary Ashton E Welch was absent.

 

2.             The Board on motion of Frank L. Eaton, seconded by Jay T. St. Jean, accepted the minutes of the November 2, 2009 meeting.

 

3.             The Board on motion on Jay T. St. Jean, seconded by Devin E. Moisan accepted the application of Ellen Curran for a NH Auctioneers License.

 

4.             The Board on motion of Frank L. Eaton, seconded by Jay T. St. Jean voted to accept and discuss the email from Deputy Attorney General Orville Fitch in reply to the question of “can a NH resident apply for reciprocity under RSA 311B:6 in conjunction with AUC 304.01-304.04 to acquire a NH license?” 

 

                Prior to the start of the meeting, the Board received a call from Anthony Blenkinsop from the Attorney General’s office stating that after much discussion between the Deputy Attorney General Orville Fitch and himself the law is presented such that anyone who lives in NH and has an auctioneers license in any of the reciprocal states may use that reciprocity to apply for a NH license so long as all other requirements are met.

 

5.             The Board on motion of Frank L. Eaton, seconded by Jay T. St. Jean voted to remove from the table, the license application of Rod Sanders which was previously tabled at the November 2, 2009 Auctioneers Meeting.  After discussion and review of the Attorney General’s Office interpretation of RSA 311B, it is confirmed that Rod Sanders must get either two recommendations from FL licensed auctioneers or retake the NH Auctioneers Exam to be approved by the Board for a license.  Therefore, on motion of Jay T. St. Jean, seconded by Frank L. Eaton, the Board voted to table Rod Sanders request for a NH Auctioneers license.

 

6.             The Board on motion of Jay T. St. Jean, seconded by Frank L. Eaton voted to reconsider the application of Paul Boudreau which was denied at the meeting of November 2, 2009.  After discussion and review of the Attorney General’s Office interpretation of RSA 311B, it is confirmed that a resident of NH may apply for a NH license through reciprocity so long as that applicant meets all other requirements.  Therefore, on motion of Jay T. St. Jean, seconded by Frank L. Eaton, the Board accepts the application of Paul Boudreau.

 

7.             The Board of motion of Devin E. Moisan, seconded by Frank L. Eaton, authorized the meeting and exam dates for 2010 as follows:

The Board on motion of Frank L. Eaton seconded by Jay T. St. Jean voted to adjourn the meeting.
