BOARD OF AUCTIONEERS MINUTES

Legislative Office Building Room 307, Concord, NH

November 5, 2012, 9:00 a.m.

 

 

1.             The Board of Auctioneers convened at 9:00 a.m. with, Chairperson Frank L. Eaton, Vice-Chairperson Russell R. Abbott, Secretary Roy W. Tilsley, and Member Richard C. Berman present.  Member Gregory J. Walsh was absent. 

 

2.             The Board on motion of Roy W. Tilsley, seconded by, Russell R. Abbott accepted the minutes of the October 1, 2012 meeting.

 

3.             The Board on motion of Richard C. Berman, seconded by Roy W. Tilsley, authorized the application of William J. Firestone for an Auctioneers License.

 

4.             The Board on motion of Roy W. Tilsley, seconded by Russell R. Abbott, authorized the application of Luiz Gonzaga for an Auctioneers License.

 

5.             The Board on motion of Roy W. Tilsley, seconded by Russell R. Abbott, authorized the application of Eve Katz for an Auctioneers License.

 

6.             The Board discussed rules.

 

7.             The Board of motion of Roy W. Tilsley, seconded by Richard C. Berman, authorized the meeting and exam dates for 2013 as follows:

8.             The Board on motion of Roy W. Tilsley, seconded by Russell R. Abbott, and further on a roll call vote as follows: Frank L. Eaton – yes, Richard C. Berman – yes, Russell R. Abbott – yes, Roy W. Tilsley – yes, and Gregory J. Walsh – absent, voted to go into non-public session to discuss matters under RSA 91-A, specifically, matters which would likely adversely affect the privacy of individuals and or matters in which litigation has been threatened against the Board.

 

9.             The Board on motion of Roy W. Tilsley, seconded by Richard C. Berman voted to come out of non-public session.

 

10.          The Board on motion of Roy W. Tilsley, seconded by Russell R. Abbott, voted to appoint an investigator / prosecutor for the complaint made by Russell Scheider. 

 

                The Board on motion of Roy W. Tilsley, seconded by Russell R. Abbott voted to appoint Richard C. Berman as investigator / prosecutor for the complaint made by Russell Scheider.

 

11.          The Board on motion of Roy W. Tilsley, seconded by Richard C. Berman, voted to appoint an investigator / prosecutor for the complaint made by Richard W. Heiser. 

 

                The Board on motion of Roy W. Tilsley, seconded by Richard C. Berman voted to appoint Russell R. Abbott as investigator / prosecutor for the complaint made by Richard W. Heiser.

 

12.          Based on the investigation and report of Russell R. Abbott, the Board on motion of Richard C. Berman, seconded by Roy W. Tilsley, voted to send Notice of Hearing in the matter of Peter E. Smith, a complaint made by Richard and Marilyn Wyant.  The Hearing will be held on December 3, 2012 at 9:30 a.m. in Room 307 of the Legislative Office Building, Concord, NH.

 

                The Board on motion of Roy W. Tilsley, seconded by Richard C. Berman, voted to have the hearing notice served to Mr. Smith via the Sheriff’s office.

 

13.          Further Business:

 

A.      The Board on motion of Russell R. Abbott, seconded by Richard C. Berman, voted to remove from the table, the request for authorization, based on the investigation and report of Roy W. Tilsley, whether or not to move forward on a complaint made by Donald M. Pepin (originally brought before the Board on 9-10-12).

 

Based on the findings of an investigation by Roy W. Tilsley, the Board found no evidence to merit a hearing on the complaint made by Donald M. Pepin, as the matter was resolved prior to completion of the investigation.  The Board on motion of Russell R. Abbott, seconded by Richard C. Berman, voted to dismiss the complaint.

 

14.          The Board on motion of Roy W. Tilsley seconded by Russell R. Abbott then Adjourned at 11:45 a.m.

 

 

The next scheduled monthly meeting will be held December 3, 2012

at the Legislative Office Building, Room 307, Concord, New Hampshire.
