GOVERNOR AND EXECUTIVE COUNCIL MINUTES

                                                                                State House, Concord, NH

The Governor and Executive Council convened at 4:00 p.m. with all members present.

The Governor and Executive Council met to consider and deliberate the Attorney General’s petition for the removal of Liquor Commissioner Mark Bodi from office.

 

After deliberating the following motions were made:

 

#1           The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Shea, and further on a roll call vote as follows: Councilor Burton – yes, Councilor Shea – yes, Councilor Hollingworth – yes, Councilor Wieczorek – yes, and Councilor Pignatelli – no, voted that the Attorney General having proved by a preponderance of evidence based on all the testimony presented at the removal hearing in this matter that Commissioner Mark Bodi committed misfeasance relative to the Liquor Enforcement Bureau’s investigation into over-serving at the Railroad Tavern in December 2009, that Commissioner Mark Bodi be and hereby is reprimanded for his actions and omissions during that investigation.

 

#2           The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Shea, and further on a roll call vote as follows: Councilor Burton – no, Councilor Shea – yes, Councilor Hollingworth – yes, Councilor Wieczorek – yes, and Councilor Pignatelli – no, voted that the Attorney General having proved by a preponderance of evidence based on all the testimony presented at the removal hearing that Commissioner Mark Bodi committed misfeasance evidenced by his actions and omissions relative to the Liquor Enforcement Bureau’s investigation into over-serving at the Railroad Tavern in December 2009, that the Governor and Council’s appointment of Mr. Bodi as Chairman of the Liquor Commission be revoked effective upon the issuance of a Decision and Order of the Governor and Council.

 

#3           The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Shea, and further on a roll call vote as follows: Councilor Burton – no, Councilor Shea – yes, Councilor Hollingworth – yes, Councilor Wieczorek – yes, and Councilor Pignatelli – no, voted that the attorneys for the Governor and Executive Council be directed to prepare a Decision and Order containing written findings for the revocation of Commissioner Bodi’s appointment of chairman, and that such Decision and Order be made available to the Governor and Executive Council prior to the October 6, 2010 meeting of the Executive Council.

 

 

The Governor concurred with the Executive Council on all motions.

 

 

 

 

Next regular Governor and Executive Council meeting is scheduled for Wednesday, October 6, 2010, at the Portsmouth City Hall, Portsmouth, NH.
