#3           Authorized to award a grant to the Town of Warner, NH, in the amount of $350,000 to correct deficiencies in the wastewater treatment facility.  Effective upon G&C approval through December 31, 2013.  100% Federal Funds. 

 

#4           Authorized to enter into an agreement with the Town of Belmont, NH, to conduct a study of the infrastructure systems located in the Lakes Region Cooperative manufactured housing park in Belmont, in the amount of $12,000.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds. 

 

#5           Authorized to award a grant to the County of Rockingham, Brentwood, NH, in the amount of $500,000 for the purpose of assisting Smuttynose Brewing Company with an equipment loan.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds. 

 

                                OFFICE OF ENERGY AND PLANNING

The Governor and Council acted as follows:

 

#6           Authorized to amend item #5 approved by G&C on February 22, 2012, by reallocating ARRA funding for Weatherization between expenditure classes in the amount of $431,550.  Effective upon G&C approval through September 30, 2012.  100% Federal ARRA Funds.  Fiscal Committee approved.

#9           TABLED – The Governor and Council on motion of Councilor Wheeler, seconded by Councilor Wieczorek, voted to table the request to enter into a contract agreement with Vermont Energy Investment Corporation, Burlington, VT, for technical assistance in the development and implementation of a statewide plan to increase cost effective capture of energy efficiency, in the amount of $215,000.  Effective upon G&C approval through September 29, 2013.  100% Federal Funds. 

 

                                OFFICE OF INFORMATION TECHNOLOGY

The Governor and Council acted as follows:

 

#10         Authorized to amend a retroactive sole source contract with CBE Technologies Inc., Boston, MA (originally approved by G&C on 12-29-06, item #1), for ongoing support and maintenance for NH State Liquor Commission Point-of-Sale systems, by increasing the amount from $1,486,528.45 to $1,620,704.05, and by extending the end date from February 1, 2012 through July 31, 2013.  100% Other (Agency Class 27) funds: the agency class 27 funds used by NHSLC to reimburse DoIT for this work is 100% Liquor funds. 

 

#11         Authorized, on behalf of the Department of Health and Human Services, to enter into a finance agreement with IBM Credit LLC, Armonk, NY, to finance the purchase of IBM software licenses and two years of software support and maintenance, for $14,902.98 ($217.98 of which is owed to IBM).  Effective upon G&C approval through October 1, 2014.  (2)Further authorized to enter into a finance agreement with IBM, Armonk, NY, to finance the purchase of IBM tape drive equipment and three years of technical support, and hardware maintenance, for $118,756.48 ($4,115.48 of which is owed to IBM).  Effective upon G&C approval through October 1, 2015.  100% Other (Agency Class 027) funds: the agency class 027 used by the Department of Health and Human Services to reimburse DoIT for this work will be 58% General and 42% Federal Funds. 

 

                                OFFICE OF THE ADJUTANT GENERAL

The Governor and Council acted as follows:

 

#12         Authorized the nomination of Edward J. O’Loughlin, Hudson, MA, for promotion to the rank of Colonel, NH Army National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally, and professionally qualified.

 

#13         Authorized the nomination of Major Richard J. Hamilton, Methuen, MA, for promotion to the rank of Lieutenant Colonel, NH Air National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally, morally, and professionally qualified.

 

#14         Authorized the nomination of Major Jonathan R. Eckerman, Chester, NH, for promotion to the rank of Lieutenant Colonel, NH Air National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally, morally, and professionally qualified. 

 

#15         Authorized to amend a contract with the Department of Health and Human Services (originally approved by G&C on 6-22-11, item #20), for the Deployment Cycle Support Program, to provide support to NH reserve military families and military members deployed or returning from combat, by increasing the price by $420,000 from $2,000,000 to $2,420,000.  Effective upon G&C approval through September 30, 2012.  100% Federal Funds. 

 

#15A      Authorized to accept and expend additional federal funds in the amount of $2,124,500 in the Army Sustainable Range Program from the federal government (National Guard Bureau) as part of the five year Federal-State Master Cooperative agreement to cover the cost of two new metal buildings at NHARNG Training Site in Center Strafford, NH, and to adjust the budget.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds.  Fiscal Committee approved. 

 

                                DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Council acted as follows:

 

#16         Authorized to accept and place on file the report containing a list of Executive Branch classified employees that have received retroactive payments relating to prior fiscal year payroll events for the period of April 1, 2012 through June 30, 2012.

 

#17         Authorized the Division of Personnel’s request for a waiver of the classification decisions as detailed in letter dated August 1, 2012.

 

#18         Authorized to amend an agreement with the City of Concord (originally approved by G&C on 3-5-08, item #19), regarding the State-owned real property located at 247-249 Pleasant Street, Concord, for an additional four months beyond the expiration of the lease on October 2, 2012.  The extension shall begin on October 3, 2012 and end on February 2, 2013.  Rent shall remain unchanged at the rate of One Dollar ($1.00).

 

#19         Authorized the Bureau of Court Facilities to enter into a lease agreement with the Town of Hooksett, NH, for courtroom and office space for the 6th Circuit District Division Hooksett Courthouse, in an amount not to exceed $145,796.40.  Effective September 1, 2012 through August 31, 2014.  100% Transfer Funds – transfer from AOC, Rent from Other Agencies. 

 

#20         Authorized to enter into a contract with Securus Technologies Inc., Dallas, TX, for Inmate Telephone Services, and Pay Telephone Services to various state agencies.  Effective upon G&C approval through February 28, 2016, with the option to extend for two years.  No State Funds will be expended for this contract.

 

#21         Authorized to enter into a contract with Enhanced Communications of Northern New England Inc., d/b/a FairPoint Long Distance – NNE, Portland, ME, for interstate long distance services, in an amount not to exceed $75,000.  Effective upon G&C approval through October 7, 2013. 

 

#22         Authorized the Bureau of Public Works Design and Construction to enter into a contract with Kevin W. Smith & Son Inc., Gorham, ME, to re-roof the Coos County Courthouse, Lancaster, NH, for a total price not to exceed $195,414.  Effective upon G&C approval through October 19, 2012.  78% Other Funds – Facilities Escrow Account, 22% Transfer Funds – Court Fees.  (2)Further authorized the amount of $24,000 for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction for engineering services provided, bringing the total to $219,414.  94.40% Transfer, 5.60% Other Funds – Court Fees. 

 

#23         Authorized the Bureau of Public Works Design and Construction to enter into a contract with Stallion Builders LLC, Nashua, NH, for the NHARNG Building ‘A’ and ‘H’ HVAC Equipment Replacement, Concord, NH, in an amount not to exceed $209,509.  (2)Further authorized a contingency in the amount of $10,000 to provide additional unanticipated expenses related to the installation of new HVAC equipment, and the removal, cleaning, and coordination with existing construction at NHARNG Building ‘A’ and ‘H’ HVAC Equipment Replacement, bringing the total to $219,509.  (3)Further authorized the amount of $12,000 for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction, for engineering services provided, bringing the total to $231,509.  Effective upon G&C approval through October 15, 2012.  100% Federal Funds. 

 

#24         Authorized the Bureau of Public Works Design and Construction to enter into a contract with Pellowe Construction LLC, Alton, NH, for the re-roof Dolloff and Londergan Hall, State Office Park South, and Pillsbury Street, Concord, NH, in an amount not to exceed $445,044.  Effective upon G&C approval through November 30, 2012.  33% General – Capital, 67% General – Operating Funds.  (2)Further authorized the amount of $6,410 for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction, for engineering services provided, bringing the total to $451,454.  35% Federal, 65% General Funds. 

 

#25         Authorized the Bureau of Public Works Design and Construction to enter into a contract with Skyline Roofing Inc., Manchester, NH, for the Campus Edge Building Roof Replacement, Sununu Youth Development Center, Manchester, NH, for a price not to exceed $90,000.  (2)Further authorized the amount of $4,100 for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction, for engineering services provided, bringing the total to $94,100.  Effective upon G&C approval through November 1, 2012.  100% Capital – General Funds. 

 

#26         Authorized the Bureau of Public Works Design and Construction to enter into a contract with Northern Peabody LLC, Manchester, NH, for the NHARNG Steam Heating System Repairs, Manchester, NH, for a price not to exceed $298,570.  (2)Further authorized the amount of $12,000 for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction, for engineering services provided, bringing the total to $310,570.  Effective upon G&C approval through December 28, 2012.  50% General, 50% Federal Funds. 

 

                                DEPARTMENT OF CULTURAL RESOUCES – NH STATE LIBRARY

#27         The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton authorized the request of the Department of Health and Human Services, in accordance with the memorandum of agreement with the NH State Library, to continue the Family Resource Connection.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds. 

 

                                STATE TREASURY

#28         The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek authorized the request to issue a warrant from funds not otherwise appropriated in the amount of $159,839, and the State Treasurer to issue checks in the amount of $159,838.05 to the rightful owners of abandoned or unclaimed funds.

#127       Authorized the Division of Fire Standards and Training and Emergency Medical Services to amend a sole source contract with ImageTrend Inc, Lakeville, MN, (originally approved by G&C on 2-25-05, item #70A), for maintenance on the Trauma and Emergency Medical Services Information System, by increasing the amount from $741,656 to $1,002,656, and by extending the completion date from December 31, 2012 to December 31, 2017.  100% Fire and EMS Funds. 

 

#128       Authorized the Division of Motor Vehicles to amend the existing lease with the City of Berlin, Berlin Industrial Development & Park Authority, Berlin, NH (originally approved by G&C on 10-11-06, item #76-A), to continue to provide the residents of the greater Berlin area with a Department of Safety, by increasing the price in the amount not to exceed $4,375.80, and by extending the term from September 1, 2012 through May 31, 2013.  100% Highway Funds. 

 

#129       Authorized the Division of Homeland Security and Emergency Management to amend the memorandum of agreement with the Department of Environmental Services Dam Bureau (originally approved by G&C on 4-18-12, item #109), which will change the initial scope of work to allow for DES to purchase a trailer-mounted heavy-duty generator in addition to a previously approved centrifugal trash pump.  Effective upon G&C approval through September 30, 2012.  100% Federal Funds. 

 

#130       Authorized to disburse to Mrs. Sheila Frey, Manchester, NH, as the surviving spouse of deceased Firefighter Harold Frey, death benefits in the amount of $100,000 as a result of Firefighter Frey’s line of duty death on January 16, 2011.  Effective upon G&C approval.  100% General Funds. 

 

#131       Authorized the petition of Ossipee Bluffs Association located on Ossipee Lake in Ossipee, NH, for temporary relocation of 7 of the 17 moorings within an established mooring field.

#132       Authorized the Division of Operations to accept and expend FEMA funds in the amount of $2,025,000 to cover May 2012 storm event costs.  100% Agency Income.  (2)Further authorized to transfer $675,000 from Highway Surplus to fund the state match of May 2012 storm event FEMA reimbursements.  Effective upon G&C approval through June 30, 2013.  100% Highway Funds.  Fiscal Committee approved. 

 

#133       Authorized the Division of Operations to accept and expend funds in the amount of $73,823 to provide engineering services for bridge reviews.  (2)Further authorized to establish a temporary part-time position of Civil Engineer IV, LG 27, and to establish a Consultant to determine bridge capacity ratings in the performance of bridge reviews for overweight permits.  Effective upon G&C approval through June 30, 2013.  100% Agency Income – Oversize/Overweight.  Fiscal Committee approved.

#135       Authorized the Bureau of Finance and Contracts to accept and expend revenue from the Federal Transportation Investment Generating Economic Recovery Grant in the amount of $20,000,000 to fund the design-build replacement of the Memorial Bridge, US Rte 1 over the Pisacataqua River between Portsmouth, NH and Kittery, ME.  100% Federal Funds.  (2)Further authorized to accept and expend revenue from the State of ME in the amount of $30,517,270 and the City of Portsmouth in the amount of $796,651 to fund the design-build replacement of the memorial Bridge, US Rte 1 over the Piscataqua River between Portsmouth, NH, and Kittery, ME.  Effective upon G&C approval through June 30, 2013.  100% Private Local Funds.  Fiscal Committee approved. 

 

#136       Authorized to accept and place on file the Monthly Equipment Acquisition Plan status report for the period ending June 30, 2012.

 

#137       Authorized the Bureau of Right of Way to transfer approximately 0.25 of an acre parcel of land used as a municipal parking lot, to the Town of Derry.  Effective upon G&C approval.

 

#138       Authorized to accept and place on file the Bureau of Right of Way’s Contemplated Awards List for amounts less than $5,000 for the sum total of $47,092 for the period extending from April 1, 2012 through June 30, 2012.

 

#139       Authorized the Bureau of Right of Way to pay various owners $30,356 as documented in the Contemplated Awards List for amounts greater than $5,000, for the period extending from June 4, 2012 through July 2, 2012.

#141       Authorized the Bureau of Right of Way to transfer a 3,200 +/- square foot parcel of State owned land located in Tilton to the Town of Tilton at no cost.  Effective upon G&C approval.

 

#142       Authorized the Bureau of Right of Way to grant a utility easement to Public Service of NH, the City of Portsmouth, and Unitil Corporation in the Town of Newington.  Effective upon G&C approval. 

 

#143       Authorized the Bureau of Right of Way to sell a 13+/- acre parcel of State owned land located on the northerly side of Interstate 93 in Franconia to David E. Howe for $19,110 which includes a $1,100 Administrative Fee.  Effective upon G&C approval.

 

#144       Authorized the Bureau of Planning and Community Assistance to enter into an agreement with the Town of Stark to provide funding and services under the National Historic Covered Bridge Preservation Program and the State Aid Bridge Program through a local project administration process, totaling $1,152,800.  Effective upon G&C approval through June 30, 2014.  78.42% Federal, 21.58% Highway Funds. 

 

#145       Authorized the Bureau of Aeronautics to award a grant to the City of Manchester, for AIP-91, for the Phase 1, terminal apron replacement at the Manchester-Boston Regional Airport, in the amount of $3,916,464.  Effective upon G&C approval through August 31, 2016.  97.3% Federal, 2.7% General Funds. 

 

#146       Authorized the Bureau of Rail and Transit to budget and expend prior year carry-forward funds in the amount of $394,317 from the Special Railroad Fund for maintenance and repair of active State-owned railroad lines.  Effective upon G&C approval through June 30, 2013.  100% Other Funds (Special Railroad Funds).  Fiscal Committee approved. 

 

#147       Authorized the Bureau of Rail & Transit to amend item #122, approved by G&C on April 1, 2009, by adjusting the appropriations in the amount of $150 for best use of the funding.  Effective upon G&C approval through June 30, 2013.  100% ARRA Funds.  Fiscal Committee approved. 

 

#148       Authorized the Bureau of Rail & Transit to enter into a Special Agreement with the Town of Salem, to salvage surplus State-owned rail materials with an estimated value of $198,750 in exchange for trail improvements along 2.6 miles of the State’s Manchester and Lawrence Railroad corridor with an estimated project value of $405,416 for use by non-motorized transportation, which will result in no cost to the State of NH.  Effective upon G&C approval. 

 

#149       Authorized the Bureau of Rail & Transit to amend a contract  with the Upper Valley Lake Sunapee Regional Planning Commission, Lebanon, NH, (originally approved by G&C on 6-22-11, item #368), for coordinated transportation services for elderly persons and persons with disabilities, by increasing the contract by $127,716 from $127,716 to $255,432.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds. 

 

#150       Authorized the Bureau of Rail & Transit to amend a contract with the County of Cheshire, Keene, NH, (originally approved by G&C on 6-8-11, item #178), for coordinated transportation services for elderly persons and persons with disabilities, by increasing the contract by $94,182 from $53,142 to $147,324.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds. 

 

#151       Authorized the Bureau of Rail & Transit to enter into an agreement with Mount Washington Valley Economic Council Inc., Conway, NH, for coordinated transportation services, for an amount not to exceed $90,878.  Effective upon G&C approval through June 30, 2013.  100% Federal Funds.
