                                                BUSINESS FINANCE AUTHORITY

#1             WITHDRAWN – The Agency withdrew the request to hold a Public Hearing with respect to the financing of a commercial facility by the Business Finance Authority for The Student Conservation Association, Inc. located in Charlestown, New Hampshire. Action will Authorized a Resolution under RSA 162-I:9 to determine the financing will serve a public use, provide public benefit and is within the policy and authority of the Act.

 

                                                COMMUNITY DEVELOPMENT FINANCE AUTHORITY

The Governor and Council acted as follows:

 

#2            Authorized to amend an existing agreement with the Town of Alstead, NH for the purpose of offering assistance to the victims of the October 8 & 9, 2005 floods, by adding an additional activity, and extending the end date from December 31, 2007 to December 31, 2008.  No additional funding is involved.  100% Federal Funds.

 

#2A        Authorized to amend an existing Agreement with the City of Keene, NH which was initially approved by the Governor and Council on July 19, 2006, Item #2, to extend the time period to complete the project from June 30, 2008 to December 31, 2009.  No additional state or federal funds are required for this action.

 

                                                OFFICE OF ENERGY AND PLANNING

The Governor and Council acted as follows:

 

#3            Authorized to enter into a retroactive, sole source contract with Lutheran Community Services of New Hampshire, Inc. of Concord, NH in the amount of $33,000.00 to provide preventive health services to New Hampshire refugees from July 1, 2007 through June 30, 2008.  100% Federal Funds.

 

#4            Authorized to enter into a sole source contract with Manchester School District in Manchester, NH in the amount of $119,815.00 to address the educational, health and mental health needs of refugee children being resettled in the City of Manchester, NH from August 15, 2007 through August 14, 2008.  100% Federal Funds.

 

#5            Authorized to enter into a retroactive, sole source contract with International Institute of Boston in Boston, MA through its subsidiary, the International Institute of New Hampshire in the amount of $33,000.00 to provide preventive health services to New Hampshire refugees from July 1, 2007 through June 30, 2008.  100% Federal Funds.

 

#6            Authorized to enter into the attached Memorandum of Agreement with the New Hampshire Fish and Game Department in Concord, NH in the amount of $27,000.00 to provide monitoring services for the State’s interests in privately owned conservation lands held by F&G, effective from date of Governor and Council approval to June 30, 2008.  100% Federal Funds.

 

#7            Authorized to enter into a Memorandum of Agreement with the Department of Resources and Economic Development in Concord, NH in the amount of $62,500.00 for the continued operation of the Business Energy Efficiency Program upon Governor and Council approval through August 15, 2008.  60% Federal Funds, 40% Other Funds.

 

                                                OFFICE OF INFORMATION TECHNOLOGY

The Governor and Council acted as follows:

 

#8            Authorized to enter into a contract with Attorney Steven G. Mednick, Law Offices of New Haven, CT in the amount of $50,000.00 for research, analysis, and documentation relating to the State’s information technology contracting process from the date of Governor and Council approval through July 31, 2008, with an option to extend through July 31, 2009.  98.47% Other Funds & 1.53% General Funds.

 

#9            Authorized Eileen Grimmer, IT Manager III to attend the 19th Annual American Academy of Certified Public Managers’ Professional Development Conference to be held September 9, 2007 through September 12, 2007 in Madison, Wisconsin, effective upon Governor and Council approval.  Further Authorized her to accept a scholarship in the amount of $1,250.00 from the New Hampshire Association of Certified Public Managers to help defray the expenses and application fees for the 19th Annual American Academy of Certified Public Managers’ Professional Development Conference.

 

                                                ADJUTANT GENERAL

The Governor and Council acted as follows:

 

#10          Authorized Major Gary J. Walker be nominated for promotion to the rank of Lieutenant Colonel, New Hampshire Air National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally, morally, and professionally qualified.

 

#11          Authorized Colonel William N. Reddel III be nominated for promotion to the rank of Brigadier General, New Hampshire Air National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally, morally, and professionally qualified.

 

#12          Authorized Mayor Wayne W. Santos be confirmed to the rank of Lieutenant Colonel, New Hampshire Army National Guard.

 

#13          Authorized to pay an unencumbered invoice in the amount of $43,935.00 to Securitas Security Services USA Inc. of Portland, ME to provide security services at the State Military Reservation in Concord, NH for the month of July 2007.   100% Federal Funds. 

 

#14          Authorized to accept donations of a Gator utility vehicle, landscaping sod and granite pavers, Cisco router and an external hard drive in the amount of $9,787.65 for the New Hampshire State Veterans Cemetery to be used for the betterment of the cemetery as listed on the attachment. 

 

                                                DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Council acted as follows:

 

#15          Authorized the permanent assignment of an Administrative services vehicle to the Director of the Bureau of Court Facilities. 

 

#16          Authorized to amend an existing contract with Berry, Dunn, McNeil & Parker of Portland, ME to conduct a readiness assessment of the Department of Transportation.  The amendment would increase the amount of the contract by $53,800.00 from $538,755.00 to $592,555.00.  100% General Funds.

 

#17          Authorized the Bureau of Graphic Services to contract with Offtech of Maine Inc. to provide repairs and maintenance to the printing and bindery equipment.  Effective July 1, 2007 or the date of Governor & Council approval, whichever is the later, to June 30, 2009.  The total contract shall not exceed $49,132.84.  100% Agency Income.

 

#18          Authorized the Bureau of Graphic Services to contract with PagePath Technologies, Inc. to provide a subscription contract for web-to-print applications and hosting.  Effective July 1, 2007 or date of Governor & Council approval, whichever is the later, through June 30, 2008, with the option to renew annually for up to two additional years.  The total amount of the contract not to exceed $11,199.00.  100% Agency Income.

                Authorized a contingency in the amount of $7,620.00 for unanticipated e-mail services and onsite training, bringing the contract total to $18,819.00.  100% Agency Income.

 

#19          Informational Item.  A report containing a list of vendors that agencies have contracted with for the period of January 1, 2007 through March 31, 2007.

 

#20          Informational Item.  A report containing a list of vendors that agencies have contracted with for the period of October 1, 2006 through December 31, 2006.

 

#21          Authorized Bureau of Court Facilities to enter into a retroactive two-month holdover amendment with the Town of Hooksett, NH providing office and courtroom space located at 101 Merrimack Street, Hooksett, NH.  The amendment will commence July 1, 2007 and expire August 31, 2007.  The two-month total shall not exceed $11,170.50.  100% Transfer Funds.

 

#22          Authorized to enter into a retroactive three-year lease agreement with the Town of Salem, NH providing office and courtroom space located at 35 Geremonty Drive, Salem, NH.  The lease agreement will commence July 1, 2007 and expire June 30, 2010.  The three-year total shall not exceed $914,969.88.  100% Transfer Funds.

                Authorized waiver of compliance with NH RSA 10:B “Clean Indoor Air” which requires performance of certain testing to certify indoor air quality in this facility.

 

#23          Authorized to enter into a contract with M. E. Latulippe Construction, Inc. of Ashland, NH for construction of a double ramp facility with parking for cars and trailers at the Lake Winnisquam Boat Access Facility, Laconia, NH for a total price not to exceed $1,427,322.00.  Effective from the date of Governor and Council approval through November 30, 2007, unless extended by the Department in accordance with the contract documents.  72% Federal Funds 28% Other Funds.

                Authorized the amount of $75,000.00 be approved for payment to the Department of Administrative Services, Bureau of Public Works Design and Construction for engineering services.

 

#24          Authorized to enter into a contract with The Lawton Company, Inc. of Litteton, NH for the patrol shed renovations located at the Department of Transportation, Franconia Patrol Shed #1247, Franconia, NH for a total price not to exceed $413,233.00.  Effective from the date of Governor and Council approval through October 30, 2007, unless extended by the Department in accordance with the contract documents.  100% Highway Funds.

                Authorized a contingency in the amount of $18,458.58 be approved for unanticipated expense for the Patrol Shed Renovations, bringing the contract total to $431,691.58.

 

#25          Authorized to enter into a contract with Schroeder Construction Management, Inc. of Nashua, NH for HVAC penthouse metal wall replacement at the Rockingham County Courthouse, Brentwood, NH for a total price not to exceed $72,438.00.  Effective from the date of Governor and Council approval through October 26, 2007, unless extended by the Department in accordance with the contract documents.  100% Transfer Funds.

 

#26          Authorized to enter into a sole source contract amendment with KPMB Enterprises, LLC of Bow, NH by increasing the contract amount by $27,292.30 from $493,000.00 to $520,292.30 for heating renovations at the NH Technical Institute, Strout Hall, Concord, NH upon Governor and Council approval through August 17, 2007, unless extended by the Department in accordance with the contract documents.  The original contract was approved by Governor and Council on May 2, 2007, Item #25.  42% General Fund 58% Student Fees.

                Authorized a contingency in the amount of $5,000.00 be approved for unanticipated expense for the Heating Renovations at the NH Technical Institute, Strout Hall, bringing the total contact to $525,292.30.

 

#27          Authorized to enter into a contract with Jewett Construction Co., Inc. of Raymond, NH for defective window replacement at Londergan Hall, Concord, NH for a total price not to exceed $440,000.00.  Effective from the date of Governor and Council approval through November 16, 2007, unless extended by the Department in accordance with the contract documents.  100% General Funds. 

 

#28          Authorized to enter into a contract with D. L. King & Associates, Inc. of Nashua, NH for tunnel repair at the NH Hospital, Hugh J. Gallen State Office Park South, Concord, NH for a total price not to exceed of $39,900.00.  Effective from the date of Governor and Council approval through October 1, 2007, unless extended by the Department in accordance with the contract documents.  100% Transfer from other agencies.

 

#29          Authorized to enter into a contract with Brookstone Builders, Inc., of Manchester NH for the expansion of the Radio Building located at the Department of Safety, 39 Hazen Drive, Concord, NH for a total price not to exceed $392,843.00.  Effective from the date of Governor and Council approval through October 25, 2007, unless extended by the Department in accordance with the contract documents. 100% Highway Funds. 

                Authorized a contingency in the amount of $38,375.37 be approved for unanticipated expense for the Safety Radio Building Expansion, bringing the contract total to $431,218.37.

                Authorized the amount of $20,000.00 be approved for payment to the Department of Administrative Service, Bureau of Public Works Design and Construction for engineering services provided.

 

#29A      Authorized Working Capital Warrant No. 08-02 in the amount of $520,000,000.00 to cover expenditures for the Month of August 2007

                Authorized acceptance of the Working Capital Warrant No. 07-12 reporting expenditures of $345,923,817.61 for the Month of June and recommends the balance of $114,076,182.39 be lapsed.

                                TREASURY DEPARTMENT

#30          The Governor and Council on motion of Councilor Weiczorek, seconded by Councilor Burton authorized the request of the Comptroller to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $233,689.13 to the rightful owners of abandoned or unclaimed funds that have escheated to the general fund. 

 

                                DEPARTMENT OF CULTURAL RESOURCES

The Governor and Council acted as follows:

 

#31          Authorized Division of Historical Resources to award a federally funded Certified Local Government Grant to the City of Concord, NH for the project, “Concord Old North Cemetery Survey” in the amount of $5,500.00 for the period of Governor & Council approval through September 30, 2007.  100% Federal Funds.

 

#32          Authorized Division of Historical Resources to award a Federally funded Certified Local Government Grant to the Town of Jaffrey, NH for the project, “Jaffrey Preservation Planning Project II” in the amount of $6,000.00 for the period of Governor & Council approval through September 30, 2007.  100% Federal Funds.

 

                                NH RETIREMENT SYSTEM

#33          The Governor and Council on motion of Councilor Shea, seconded by Councilor Burton authorized the request to transfer between classes of appropriations allotted under the Warrant dated July 1, 2006, Chapter 176, Laws of FY 2005, in the amount of $3,000,000.00 from that appropriation for Class 091, Normal Contributions, to Class 092, Retirees Health Insurance, to adjust the budget.  Fiscal Committee Approved.

 

                                DEPARTMENT OF AGRICULTURE, MARKETS & FOOD

The Governor and Council acted as follows:

 

#34          Authorized Division of Animal Industry to accept and expend grant funds from the USDA Animal and Plant Health Inspection Service in the amount of $13,064.00 for the period of Governor and Council approval through December 31, 2007 to be used to provide financial assistance to the State in conducting risk assessments, testing, surveillance, training and education for the Johnes Disease Program.  100% Federal Funds. 

 

#35          Authorized Division of Animal Industry, to accept and expend grant funds form the USDA Animal and Plant Health Inspection Service in the amount of $27,450.00 for the period of Governor and Council approval through December 31, 2007 to be used to provide financial assistance to the State to recognize, respond to, and recover from any Foreign Animal Disease outbreak.  100% Federal Funds. 

 

                                DEPARTMENT OF JUSTICE

The Governor and Council acted as follows:

 

#36          Authorized to retroactively amend Governor and Council item #48 approved by Governor and Council on November 15, 2006 and approved by fiscal committee on October 18, 2006 by extending the end date only, with no increase in funding, of the federal award received from the Administration for Children and Families, United States Department of Health and Human Services, utilized in support of improving the criminal justice system’s response in the handling of actual or suspected cases of child abuse or neglect in the State, from the original end date of June 30, 2007 to a new end date of September 30, 2008.  100% Federal Funds.   Fiscal Committee Approved.

 

#37          Authorized to accept and expend a grant from the US Department of Justice Office for Victims of Crime, Victims of Crime Act Grant Program in the amount of $1,992,000.00 to fund programs providing direct services to victims of crime, from July 1, 2007 to June 30, 2009.  100% Federal Funds.  Fiscal Committee Approved.

 

#38          Authorized to accept a grant in the amount of $80,000.00 from the US Department of Justice Office for Victims of Crime, Victims of Crime Act Grant Program, from the period of Governor and Council approval through June 30, 2009.  These funds will go directly to victims of crime to compensate them for losses resulting from their victimization (i.e. medical expenses, lost wages, mental health, funeral expenses, etc.)  100% Federal Funds.  Fiscal Committee Approved.

 

#39          Authorized to retroactively amend Governor and Council Late Item #D, approved by Governor and Council on September 27, 2006 and approved by fiscal committee on September 19, 2006, by extending the end date only, with no increase in funding, of the federal grant received from the Federal Bureau of Justice Statistics (Federal Fiscal Year 2004-2005 National Criminal History Improvement Program) from the previous end date of June 30, 2007 to a new end date of September 30, 2007.  100% Federal Funds.  Fiscal Committee Approved.

#123        Authorized Vance Sedlar’s request to permanently remove a non-conforming breakwater and docking structure and fill 750 sq ft to construct 44 linear ft of breakwater in an “I” configuration with a 6ft gap at the shoreline and a 4 ft x 44 ft cantilevered pier connected to a 6 ft x 40 ft permanent piling supported dock to be accessed by a 6 ft x 12 ft permanent walkway on an average of 101 ft of frontage on Lake Winnipesauke in Alton.  File # 2007-00441.

 

#124        Authorized Bow Lakes Estates Property Management Corp’s request to permanently remove all existing docking structures on the frontage and construct one seasonal docking structure consisting of four, 4 ft x 30 ft seasonal docks connected by a 4 ft x 46 ft seasonal walkway accessed by a 4 ft x 6 ft walkway from the shore on an average of 329 ft of frontage on Bow Lake in Strafford, NH.  File #2006-02321.

#175        Authorized to enter into a contract with Enpro Services Inc. of Pembroke, NH on the basis of a low bid of $666,232.00 for the construction of vehicle fueling sites in Hooksett and Rindge from the date of Governor and Council approval through November 2, 2007.  100% Highway Capital Funds. 

                Further Authorized a contingency in the amount of $66,623.00 be approved for payment of latent conditions, which may appear during execution of the project.

 

#176        Authorized to enter into an contract with Enpro Services Inc. of Pembroke, NH on the basis of a low bid of $642.568.00 for the construction of vehicle fueling sites in Enfield and Sunapee from the date of Governor and Council approval through November 9, 2007..  100% Capital Funds. 

                Further Authorized a contingency in the amount of $64,257.00 be approved for payment of latent conditions, which may appear during execution of the project.

 

#177        Authorized to exercise a contract renewal with R&R Communications, Inc of Swanzey, NH in the amount of $142,320.00 for the purpose of providing statewide radio maintenance and service for the Department’s mobile radio system.  The contract period is from date of Governor and Council’s approval until June 30, 2009.  Governor and Council originally approved the two year contract on October 5, 2005, Item #141. 

 

#178        Authorized to enter into a retroactive contract amendment with the Southern NH Planning Commission of Manchester, NH in the amount of $20,320.00 to complete a study of the feasibility of bus service between Manchester and Portsmouth by extending the completion date to December 31, 2007 from the original contract end date of June 30, 2007.  The original agreement was approved by Governor and Council on October 5, 2005, Item #139.  No additional funding is involved in this time extension.  80% Federal Funds, 20% Highway Funds. 

 

#179        Authorized to enter into a contract with Concord Aviation Services of Concord, NH in an amount not to exceed $16,000.00 for rental of aircraft.  Effective on Governor and Council approval from July 1, 2007 through June 30, 2009.  50% General Funds, 50% Highway Funds. 

 

#180        Authorized to enter into a contract with Thisbe & Shmoop Cleaning Co of Lancaster, NH in the amount of $13,200.00 for janitorial services at the District One Highway Maintenance Office from July 1, 2007 through June 30, 2009.  100% Highway Funds. 

 

#181        Authorized to exercise a contract renewal option with Susan E. Marshall, Esq. of Hopkinton, NH for writing administrative rules from the date of Governor and Council approval through June 30, 2009.  The original contract was approved by Governor and Council on October 21, 2005, Item #100.  Contract total is $15,000.00.  100% Highway Funds. 

 

#182        Authorized to enter into a contract with Richard L. Hodgkinson Management and Consulting Services of Londonderry, NH in the amount of $45,000.00 for supervisory/leadership training from date of Governor and Council approval through June 30, 2008 with the option to renew for an additional one year period subject to Governor and Council approval.  33% Federal Funds, 67% Highway Funds. 

 

#183        Authorized to enter into a lease agreement from the date of Governor & Council approval through June 12, 2008 for a parcel of land with a private pedestrian crossing with DPM Realty Trust of Laconia, NH on the State-owned Concord to Lincoln Railroad Line in Laconia for $1,300.00 per year. 

 

#184        Authorized to amend a grant to provide additional funding to the City of Claremont, NH for the construction of an aircraft hangar and reconstruction of Taxiway “B” at the Claremont Municipal Airport totaling $72,978.24.   Effective upon Governor and Council approval through July 31, 2012.  97.44% Federal Funds, 2.56% State Funds. 

 

#185 Authorized to amend a grant to provide additional funding to the City of Lebanon, NH for AIP-23 to construct additional terminal building improvements.  Total:  $31,350.00.  Effective upon Governor and Council approval.  94.74% Federal Funds, 5.26% General Funds.
