#1           The Governor and Council on motion of Councilor Pignatelli, seconded by Councilor Burton authorized the request to amend an agreement with the Town of Newport, NH, (previously approved by G&C on 8-23-06, item #4), for the purpose of acquiring and preparing a property to construct affordable elderly housing in Newport by extending the completion date to June 30, 2009 from June 30, 2008.  100% Federal Funds. 

 

                                GOVERNOR’S COMMISSION ON DISABILITY

#1A        The Governor and Council on motion of Councilor Burton, seconded by Councilor Shea authorized the request to accept and expend from seminar attendees an amount not to exceed $800 to cover the cost of registration fees and lunch for a Legislative Process Training Seminar to educate persons with disabilities and the general public on the Legislative process in the State of NH on May 30, 2008.  Effective upon G&C approval through June 30, 2008.  100% Other Funds.

#4           Authorized OIT and the Department of Environmental Services to amend a sole source, retroactive contract with EMC Legato Corporation, Hopkinton, MA (previously approved by G&C on 4-4-07, item #58), for renewal of license subscription, software upgrades, and technical support services for the installed electronic file storage management software Legato Disk Xtender, by increasing the amount by $4,968 from $8,555.59 to $13,523.59.  Effective January 20, 2008 through January 19, 2010.  100% Other (Agency) Funds.

#6           Authorized to enter into a sole source contract with First Data Government Solutions, Englewood, CO, for support and maintenance of a proprietary interactive voice response system that provides child support payment information to clients and claims payment information to childcare providers for the Department of Health and Human Services, Division of Child Support Services and Division for Children, Youth and Families in the amount of $102,735.64.  Effective upon G&C approval through January 31, 2011.  100% Other (Agency) Funds. 

 

#7           Authorized to enter into a retroactive contract with Software House International Incorporated, Paxton, MA, for software and peripheral services, including support services and maintenance, to sustain day-to-day operational needs of agencies within several state agencies in the amount of $26,450.  Effective September 1, 2007 through May 31, 2009.  100% Other (Agency) Funds. 

 

                                OFFICE OF THE ADJUTANT GENERAL

The Governor and Council acted as follows:

 

#8           Authorized Major Robert P. Blonigen, Newington, NH, be confirmed for promotion to the rank of Lieutenant Colonel, NH Air National Guard.

 

#9           Authorized Captain Michael E. Terry, Sunapee, NH, be nominated for promotion to the rank of Major, NH Army National Guard.  This officer meets all prerequisites for this grade, having been found to be physically, mentally and professionally qualified.

 

#10         Authorized to accept and expend additional funds in the amount of $94,559 from the federal government (National Guard Bureau) to pay for employee salaries, benefits, audit and post retirement costs.  These costs shall be reimbursed 100% by the federal government.  Effective upon G&C approval through June 30, 2008.  Fiscal Committee approved. 

 

                                DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Council acted as follows:

 

#11         Authorized a Working Capital Warrant in the amount of $470,000,000 to cover expenditures for the Month of June 2008.  (2)Further Authorized a Working Capital Warrant reporting expenditures of $338,127,681.28 for the Month of April and recommends the balance of $71,872,318.72 be lapsed.

 

#12         Authorized to accept and place on file the Report and Findings of Councilor Beverly Hollingworth with regard to the financing of certain equipment and certain routine capital expenditures in connection with Wentworth Douglas Hospital, Dover, NH.

 

#13         Authorized Employee Benefit Adjustment Fund transfers for the Months of March through April.

 

#14         Authorized a list of agency transfers for Fiscal Year 2008 during the month of April 2008.

 

#15         Authorized to enter into a contract with Amoskeag Maintenance Services LLC, Concord, NH for sand sweeping and removal services in an amount not to exceed $13,450.  Effective upon G&C approval through July 31, 2008.

 

#16         Authorized Bureau of Public Works Design & Construction to enter into an agreement with DuBois & King Inc., Randolph, VT, for professional Mechanical Services required for planning, design and construction of various Public Works’ Projects in an amount not to exceed $300,000.  Effective upon G&C approval through June 30, 2011.

 

#17         Authorized Bureau of Public Works Design and Construction to enter into a contract with Cape Ann Equipment LLC, North Andover, MA, for the North Beach Seawall Repair, Route 1-A, Hampton, NH, for a total price not to exceed $885,000.  Effective upon G&C approval through December 31, 2008.  (2)Further Authorized a contingency in the amount of $115,000 for unanticipated expenses or the North Beach Seawall Repair, Route 1-A, Hampton, NH, bringing the total to $1,000,000.  100% General Funds. 

 

#18         Authorized Bureau of Public Works Design and Construction to enter into a contract with Northern Peabody LLC, Manchester, NH, for Chiller & Tower Replacement Men’s Prison, Concord, Boiler Room Upgrades at Men’s & Women’s Prison, Concord and Goffstown, and HVAC and Water Upgrades at Shea Farm, NorthEnd House, Concord MSU, Concord District Office and Calumet House, for a total price not to exceed $1,057,250.  Effective upon G&C approval through October 1, 2008.  (2)Further Authorized a contingency in the amount of $54,245 for unanticipated expense for Chiller & Tower Replacement, bringing the total to $1,111,495.  100% General Funds. 

 

#19         Authorized Bureau of Public Works Design and Construction to enter into an agreement with Edwards and Kelcey Inc., Manchester, NH, for professional Civil/Structural services required for planning, design and construction of various Public Works’ Projects in an amount not to exceed $500,000.  Effective upon G&C approval through June 30, 2011. 

 

#20         Authorized Bureau of Public Works Design and Construction to amend a contract with Eckhardt & Johnson Inc., Manchester, NH (previously approved by G&C on 9-5-07, item #13), for the Sutton Rest Area HVAC renovations, by increasing the amount by $38,016 from $397,431 to $435,447.  Effective upon G&C approval through June 30, 2008.  (2)Further Authorized payment of $1,300 to the Department of Administrative Services, Bureau of Public Works Design and Construction for engineering services provided, bringing the total to $39,316.

 

#20A      Authorized Bureau of General Services to enter into a contract with Bow Plumbing and Heating Corp., Bow, NH, to provide downspout and drain cleaning services a the Legislative Office Building in Concord for a total amount not to exceed #16,060.  Effective upon G&C approval through June 9, 2008.  100% General Funds. 

 

#20B      Authorized Bureau of Public Works Design and Construction to amend a contract with Horne Construction Company Inc., Rochester, NH, (previously approved by G&C on 6-13-07, item #33), for new waterproof membrane and sealer repairs at the Skyhaven Airport, Rochester, NH, by increasing the amount by $7,028 from $100,578 to $107,606.  Effective upon G&C approval through July 1, 2008.  100% Private Funds. 

 

#20C      Authorized Bureau of Court Facilities to accept the transfer of land located at 6 Baboosic Lake Road, Merrimack, NH, from the Town of Merrimack at no cost to the State.

 

 

#20D      Authorized to amend a contract with Robert Half International Inc., Manchester, NH, for professional assistant in the areas of accounting and technical policy and procedure documentation in conjunction with the implementation of the new Enterprise Resource Planning system, by increasing the price by $78,000 from $56,768 to $134,768.  Effective upon G&C approval. 

 

#20E      Authorized Bureau of Facilities and Assets Management to enter into a contract with the F.A. Bartlett Tree Experts Company d/b/a Bartlett Inc., Hooksett, NH, for tree trimming and debris removal located at the Hugh J. Gallen State Office Park, Concord, NH, for a total amount not to exceed $3,555.  Effective upon G&C approval through June 30, 2008.  100% Other Funds. 

 

                                TREASURY DEPARTMENT

The Governor and Council acted as follows:

 

#21         Authorized to exercise a two-year contract renewal option with Public Resources Advisory Group Inc., New York, NY (previously amended by G&C on 4-9-08, item #18), for financial advisory services, including debt affordability and debt management, by increasing the amount by $180,750 from $319,250 in an amount not to exceed $500,000.  Effective July 1, 2008 through June 30, 2010.  100% Capital Funds. 

 

#22         Authorized to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $55,824.88 to the rightful owners of abandoned or unclaimed funds.

 

#23         Authorized to transfer appropriated funds in the amount of $365,000 for debt service payments.  Effective upon G&C approval through June 30, 2008.  100% General Funds.  Fiscal Committee approved. 

 

#24         Authorized to accept and expend $1,200,000 of Unique Plan Management fee revenues from the NH Excellence in Higher Education Endowment Trust Fund for the purpose of providing educational scholarships.  Effective upon G&C approval through June 30, 2008.  100% Other Funds.  Fiscal Committee approved. 

 

                                DEPARTMENT OF CULTURAL RESOURCES

#25         The Governor and Council on motion of Councilor Shea, seconded by Councilor Burton authorized the request of the Division of Libraries to enter into an agreement with Wayne Thibodeau Sr. d/b/a WT’s Reliable Janitorial Service, Penacook, NH, for cleaning 7,233 sq ft of department offices in the amount of $7,732.62.  Effective upon G&C approval through June 30, 2009.  100% Federal Funds. 

 

                                DEPARTMENT OF AGRICULTURE, MARKETS & FOOD

#26         The Governor and Council on motion of Councilor Burton, seconded by Councilor Shea authorized the request to accept and expend funds in the amount of $5,400 from the US Department of Agriculture, Agricultural Marketing Service to reimburse the department for conducting audits at retail markets and for administering the USDA Country of Origin Labeling Program.  Effective upon G&C approval through June 30, 2009.  100% Federal Funds.

#27         Authorized to reappoint Susan P. McGinnis as a Senior Assistant Attorney General, at a salary level of $69,770.48.  Effective May 21, 2008 through May 21, 2013. 

 

#28         Authorized to enter into subgrants with the organization as detailed in letter dated May 7, 2008, in the total amount of $151,945 to fund programs providing direct services to victims of crime.  Effective upon G&C approval through September 30, 2009.  100% Federal Funds.

#32         Authorized to enter into subgrants with the agencies as detailed in letter dated May 1, 2008, totaling $30,000 from the previously accepted 2007 Violence Against Women Formula Grant, designed to provide services for women in NH who are victims of violent crimes.  Effective upon G&C approval through February 28, 2009.  100% Federal Funds.

#43         Authorized Division of Parks and Recreation to amend a sole source contract with White Mountain Communication Corp., Randolph, NH, (previously amended by G&C on 6-13-07, item #102), for the Mt. Washington Summit Power Project, Phase 2C, by increasing the amount by $70,167 from $153,365 to $223,532.  Effective upon G&C approval through June 30, 2009.  100% General Funds. 

 

#44         Authorized Division of Parks and Recreation to accept a Conservation Easement from the City of Berlin for approximately 26.6 acres adjacent to Berlin High School, City of Berlin, NH as part of a wetlands mitigation requirement for the wetlands permit for the Greenova, LLC wood pellet processing facility in the Berlin Industrial Park.

 

#45         Authorized Trails Bureau to amend a retroactive contract with the Presidential Range Riders Snowmobile Club, Gorham, NH, (previously amended by G&C on 3-5-08, item #38), for winter trail grooming and plowing from December 15, 2007 through April 2, 2008, by increasing the amount b7 $3,239.33 from $19,680 to $22,919.33.  100% Trails Bureau Funds. 

 

#46         Authorized Division of Parks and Recreation to accept and expend a grant of $20,000 from Public Service of NH, Manchester, NH, for interpretive programs.  Effective upon G&C approval through October 31, 2008.

#75         Authorized Michael Goodridge’s request to remove an existing unAuthorized non-conforming tidal dock system, and replace with a reduced and conforming tidal docking structure consisting of a permanent pier, connecting to a ramp connecting to a landing float, connecting to a T float section running parallel to shore, providing a total of 6 slips on frontage on Sagamore Creek in Portsmouth.

 

#76         Authorized Edge of Lake Association’s request to repair two existing 3 pile ice clusters and add two new 3 pile ice clusters to protect an existing 36 slip permanent docking facility and to dredge from lakebed along property on Lake Winnipesaukee in Tuftonboro.

 

#77         Authorized John & Catherine Fisher’s request to construct a seasonal dock accessed by a walkway on property on the Nashua River in Nashua.

 

#78         Authorized Chieftain Motor Inn’s request to construct a seasonal wharf accessed by two seasonal ramps, completely remove pea stone placed over the bank and on the bed of the river, and install access stairs from the beach to the waterbody on the Connecticut River in Hanover.

 

#78A      Authorized to enter into a contract with Vanesse Hangen Brustlin, Bedford, NH, for the purpose of developing a watershed strategy for wetlands restoration and protection in the Merrimack River watershed in the amount of $56,000.  Effective upon G&C approval through January 31, 2009.  100% Federal Funds.

#81         Authorized to amend a sole source agreement with Northeast Record Retention LLC, Hooksett, NH, (previously amended by G&C on 3-21-07, item #54), to provide for the storage of paper records, by increasing the price by an amount not to exceed $55,000 from $280,541.44 to $335,541.44, and by extending the completion date from June 30, 2008 to June 30, 2009.  66% General, 34% Federal Funds.
