The Governor and Council acted as follows:

 

#8            Authorized NH State Library to accept and expend a grant in the amount of $5,000 from the National Endowment for the Humanities for Assessing 18th and 19th Century NH Maps and Atlases.  Effective upon G&C approval through June 30, 2008.  100% Federal Funds. 

 

#9            Authorized Division of Arts to award a Community Arts Project grant to the Vermont Arts Exchange, North Bennington, VT, in the amount of $6,500.  Effective upon G&C approval through June 30, 2006.  100% General Funds.

#10B       Authorized to accept and expend $125,000 in Fiscal Year 2006 additional program revenues.  Effective upon G&C approval through June 30, 2006.  Fiscal Committee approved.

The Governor and Council acted as follows:

 

#11          Authorized retroactive purchase and payment of a new Dell Laptop, Latitude D610 Pentium M740, with MS Office Professional, from Dell Marketing LP in the amount of $1,747.78.  100% Federal Funds. 

 

#12          Authorized Bureau of Markets to amend a grant with the University of NH Cooperative Extension, Durham, NH, (previously approved by G&C on 11-10-04, item #19, amended on 8-31-05, item #52A), in the amount of $5,000, for providing assistance with planning and conducting risk management education training programs for farmers in NH, by extending the completion date to June 30, 2006 from December 30, 2005.  100% Federal Funds. 

 

#13          Authorized to enter into a contract with Michele L Tremblay, d/b/a naturesource communications, Boscawen, NH, to provide administrative services for the State Conservation Committee, in the amount of $88,200.  Effective upon G&C approval through September 30, 2007.  57% General, 43% Other Funds. 

 

                                TREASURY DEPARTMENT

#14          The Governor and Council on motion of Councilor Burton, seconded by Councilor Pignatelli authorized the request to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $5,090.77 to the rightful owners of abandoned or unclaimed funds.  100% General Funds. 

 

                                DEPARTMENT OF REVENUE ADMINISTRATION

#15          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding authorized the request to enter into a contract with Robert Half International Inc., Manchester, NH, for temporary personnel services, in the amount of $63,000.  Effective upon G&C approval through June 30, 2007.  100% General Funds. 

                               

EMPLOYMENT SECURITY

The Governor and Council acted as follows:

 

#16          Authorized to enter into a memorandum of agreement with the NH Department of Resources and Economic Development to conduct a survey of DRED customers to evaluate the impact of business services in the amount of $9,400.  (2)Further Authorized an advance payment in the amount of $9,400 to NHES in accordance with the terms of the memorandum of agreement.  (3)Further Authorized to accept and expend funds from DRED in the amount of $9,400 in accordance with the memorandum of agreement between NHES and DRED for the described services.  Effective upon G&C approval through September 30, 2006.  100% Transfer Funds.

 

#17          Authorized to enter into a contract with Hi-Way Safety Systems Inc, Hanover, MA, for parking lot striping services at NHES offices statewide in an amount not to exceed $12,780.  Effective upon G&C approval through June 30, 2008.  100% Federal Funds. 

 

#18          Authorized to enter into a contract with The Scott Lawson Group Ltd. Concord, NH, for ergonomic workstation set-up, evaluation and follow-up services at NHES offices statewide in an amount not to exceed $14,000.  Effective upon G&C approval through June 30, 2008.  100% Federal Funds.

                                ATTORNEY GENERAL

The Governor and Council acted as follows:

 

#21          Authorized to retroactively accept and expend a grant in the amount of $25,543.58 from the US Attorney’s Office for the District of NH, to be utilized to support a drug enforcement officer position with the NH Drug Task Force.  Effective January 16, 2006 through July 16, 2006.  100% Federal Funds. 

 

#21A      Authorized to expend a sum not to exceed $300,000 from funds not otherwise appropriated for the purpose of covering projected shortfalls in the general litigation expenses incurred in the defense of the State and the prosecution of criminal law.  Fiscal Committee approved. 

 

                                HIGHWAY SAFETY AGENCY

The Governor and Council acted as follows:

 

#22          Authorized to accept and expend $33,037.73 in federal highway safety funds from the National Highway Traffic Safety Administration for the development and implementation of a statewide safety program.  Effective upon G&C approval through June 30, 2006.  100% Federal Funds. 

 

#23          Authorized to enter into a sole source contractual agreement with the NH Fisher Cats baseball team to coordinate a highway-safety related advertisement campaign during the 2006 season home games in the amount of $16,000.  Effective upon G&C approval through September 15, 2006.  100% Federal Funds. 

 

                                INSURANCE DEPARTMENT

#24          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton authorized the request to enter into a retroactive educational tuition agreement with Southern NH University, Manchester, NH, for Christine Wenners to participate in the course entitled Human Resources Management, during the period of March 6, 2006 through April 30, 2006 and to pay such costs in the amount of $750.  100% Other Funds. 

 

                                PUBLIC UTILTIES COMMISSION

#25          The Governor and Council on motion of Councilor Griffin, seconded by Councilor Spaulding authorized the request of intervenor compensation by the NH Public Interest Research Group in the amount of $10,000.  This compensation would be payable to the NH Public Interest Research Group directly from Public Service Company of NH, Granite State Electric Systems at $2,500 each.

 

                                LIQUOR COMMISSION

The Governor and Council acted as follows:

 

#26          Authorized to accept and expend Sweepstakes Incentive Award Funds from the Tri-State Lottery Commission, South Barre, VT, in the amount of $462.87.  Effective upon G&C approval through June 30, 2006.  100% Other Funds. 

 

#27          Authorized to amend a contract with Griffin Bodi & Krause Inc., Manchester, NH, (previously approved by G&C on 6-25-03, item #91), for the sole purpose of providing advertising, merchandising and communications programs, by increasing the price limitation of $2,862,715 from $2,341,350 to $5,204,065, and by extending the termination date through June 30, 2008.  99% General, 1% Other Funds. 

 

                                DEPARTMENT OF CORRECTIONS

The Governor and Council acted as follows:

 

#28          Authorized to enter into a contract with WR Bevans Fire Alarms Inc., Boscawen, NH, for maintenance, testing and repair of the building service and fire protection equipment connected to the detection, alarm, and communications systems in the amount of $11,920.  Effective May 1, 2006 or upon G&C approval, whichever is later, through April 30, 2008 with the option to renew for an additional period of up to two years upon G&C approval.  100% General Funds. 

 

#28A      Authorized to transfer budgeted grant funds in the amount of $40,424.07 between PAU classes as detailed in letter dated March 9, 2006 of the appropriation warrant dated July 1, 2005.  This adjustment is necessary to update the account classes to match up with the amended amount of the NH Department of Justice grant as amended April 5, 2005.  Fiscal Committee approved. 

 

                                JOINT BOARD OF LICENSURE AND CERTIFICATION

#29          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton authorized the request to enter into a sole source contract with the National Association of State Boards of Geology, Columbia, SC, for the preparation and scoring of the national Geologist examiners in the amount of $30,000.  Effective May 1, 2006 through April 30, 2008.  (2)Further Authorized unencumbered payments under this contract with internal accounting control.  100% General Funds. 

 

                                DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Council acted as follows:

 

#30          Authorized Division of Economic Development to award a grant to the City of Manchester, Manchester, NH, for a marketing initiative for the City of Manchester in the amount of $25,000.  Effective upon G&C approval through December 31, 2006.  100% General Funds. 

 

#31          Authorized Division of Economic Development to award a grant to the City of Franklin, Franklin, NH, for a marketing initiative for the City of Franklin in the amount of $20,000.  Effective upon G&C approval through March 1, 2007.  100% General Funds. 

 

#31A      Authorized Division of Forests and Lands to accept a $1,970,000 Federal grant and assign the grant directly to The Trust for Public Land to pay the purchase price for acquisition of a Conservation Easement on 557+/- acres in the City of Concord, NH, known as Rossview Farm.  (2)Further Authorized to accept 557+/- acre Conservation Easement, and enter into a Snowmobile Agreement to insure continued access to the properties for this use.  (3)Further Authorized to reimburse The Trust for Public Land for the cost of a title policy estimated at $6,000 for the property on which the conservation easement will be acquired.  Fiscal Committee approved. 

 

                                FISH AND GAME DEPARTMENT

The Governor and Council acted as follows:

 

#32          Authorized to compensate Daniel A Brooks, Conservation Officer I, retroactive pay in the amount of $2,790.90 for an incremental step effective October 17, 2004 through March 2, 2006 using FY06 funds.  100% Fish and Game Funds. 

 

#33          Authorized to enter into a Grant Agreement with the Rockingham Land Trust Inc, Exeter, NH, to provide the Rockingham Land Trust Inc. with $193,363 from the State Wildlife Grants Program to acquire 316 acres of land in the Towns of Newfields and Newmarket, NH.  100% Federal Funds. 

 

#34          Authorized to enter into a contract with the Town of Seabrook, NH, to construct a sea wall and to repair or upgrade facilities at Yankee Co-Op, Seabrook, NH, for an amount not to exceed $315,812.   Effective upon G&C approval through September 30, 2006.  100% Federal Funds. 

 

#35          Authorized to amend a memorandum of agreement with the Department of Environmental Services (previously approved by G&C on 7-13-05, item #60), for the development of public water access areas for boating on public water bodies, by extending the end date from June 30, 2006 to June 30, 2007.

 

#35A      Authorized to accept and expend $45,000 from the US Fish and Wildlife Service to fund the purchase and equipping of an Anadromous fish stocking truck.  (2)Further Authorized to accept and expend a $5,000 donation from the Theodore Roosevelt Conservation Partnership to fund the purchase and equipping of and Anadromous fish stocking truck.  (3)Further Authorized to accept and expend a $10,000 donation from the NH Trout Unlimited Council to fund the purchase and equipping of an Anadromous fish stocking truck.  Effective upon G&C approval through September 30, 2006.  Fiscal Committee approved. 

 

#35B       Authorized to accept and expend $50,000 from State Wildlife Grant Funds received from the US Fish and Wildlife Service for the purpose of assisting towns within the I-93 corridor with future growth and land protection guidance.  Effective upon G&C approval through June 30, 2007.  Sole Source.  Fiscal Committee approved. 

 

                                DEPARTMENT OF ENVIRONMENTAL SERVICES

The Governor and Council acted as follows:

 

#36          Authorized to pay membership dues retroactively to the Association of US Delegates to the Gulf of Maine Council on the Marine Environment, South Portland, ME, in the amount of $15,000.  Effective upon G&C approval.  50% Federal, 50% General Funds. 

 

#37          Authorized to enter into a Cooperative Project Agreement with the University of NH – Office of Sponsored Research, Durham, NH, for $7,500 for intern training and participation in the P2 Program’s assistance projects.  Effective upon G&C approval through September 30, 2006.  100% Federal Funds.

#41          Authorized to exercise a one year contract renewal option with PerkinElmer LAS Inc., Shelton, CT, (previously approved by G&C on 6-22-05, item #137), to provide maintenance on two gas chromatographs and one automated thermal desorber in the amount of $8,088.  Effective upon G&C approval through May 31, 2007.  100% Federal Funds. 

 

#42          Authorized to approve a loan agreement amendment with the City of Franklin, NH, to finance the replacement of the Route 3A and Route 11 Sewers, by increasing the loan by $6,650 from $803,350 to $810,000.  Effective upon G&C approval.  100% Other Funds. 

 

#43          Authorized to approve a loan agreement with the Town of Jaffrey, to finance the upgrade of the Town’s Wastewater Treatment Facility in the amount of $1,307,154.34.  Effective upon G&C approval.  100% Other Funds. 

 

#44          Authorized to approve a loan agreement with the City of Somersworth to finance sewerage system improvements in the amount of $1,836,616.  Effective upon G&C approval.  100% Other Funds. 

 

#45          Authorized an original loan agreement with Pennichuck Water Works Inc., to finance improvements to the existing surface water treatment facility subject to conditions as outlined in documents substantially in the form presented in the amount of $3,000,000.  Effective upon G&C approval.  83% Federal, 17% Capital General Funds.

 

#46          Authorized to award a Local Source Water Protection grant to the City of Franklin Water Department, Franklin, NH, to complete a project to protect drinking water from contamination in the amount of $15,000.  Effective upon G&C approval through June 30, 2007.  100% Federal Funds. 

 

#47          Authorized to award Household Hazardous Waste grants to the entities as detailed in letter dated February 17, 2006, for the purpose of conducting household hazardous waste collection projects totaling $42,816.08.  Effective upon G&C approval through June 30, 2006.  100% Other Funds. 

 

#48          Authorized James Mooney’s request to fill, construct breakwater in an “L” configuration with a gap at the shoreline and a cantilevered pier accessed by a cantilevered walkway and a wharf along the shore on frontage providing 2 boatslips on Lake Winnipesaukee in Alton.

 

#49          Authorized Richard Wozmak’s request to fill, construct breakwater in a “dogleg” configuration with a gap at the shoreline, and a cantilevered pier and drive 2 tie-off pilings on frontage on Lake Winnipesaukee in Alton.

#50          Authorized to amend an agreement with the Secretary of the US Department of Health and Human Services and the State of NH on behalf of the Town of Ashland, for the purpose of adopting the optional exclusion from Social Security and Medicare coverage for the services preformed by election workers for each calendar year in which the remuneration paid for such services is less then $1,300.

#51          Authorized to make payment to Aspen Publishers Inc., Frederick, MD, for Loislaw Internet Legal Services, in the amount of $2,880.  Effective upon G&C approval.  50% Federal, 50% General Funds.

#82          Authorized Bureau of Rail & Transit to grant an easement to the NH Electric Cooperative for overhead and underground electrical distribution and transmission lines and current laterals on the State-owned Concord to Lincoln railroad corridor in the Towns of Thornton and Woodstock, for a one-time fee of $5,000.

 

#83          Authorized Bureau of Environment to enter into a qualification-based contract with Jacques Whitford Company Inc., Portsmouth, NH, to develop and manage a Statewide Underground Storage Tank Management Program in the amount of $600,000.  Effective upon G&C approval through June 30, 2011 with the option to renew for an additional three year period subject to G&C approval.  100% Highway Funds.

#85          Authorized Bureau of Construction to amend a contract with R.D. Edmonds & Sons Inc., Franklin, NH, (previously approved by G&C on 10-20-04, item #125), for reconstruction of approximately 1.5 miles of NH Route 11 west of 3A and the reconstruction of the intersection of Routes 3A and Route 11 in Franklin, NH, by increasing the contract by $218,000 from $2,549,214.10 to $2,767,214.10.  80% Federal, 20% Highway Funds. 

 

#86          Authorized Bureau of Construction to amend a contract with Weaver Bros. Construction Co. Concord, NH, (previously approved by G&C on 10-20-04, item #120, amended on 8-31-05, item #218), for pavement rehabilitation and safety work along 2.4 miles of Route 11 in the Town of Andover and the City of Franklin, by increasing the amount by $63,000 from $3,264,870.75 to $3,327,870.75.  80% Federal, 20% Highway Funds. 

 

#87          Authorized Bureau of Construction to amend a contract with S.U.R. Construction Inc., Rochester, NH,  (previously approved by G&C on 5-18-05, item #95), for additional work associated with interim safety improvements within the Spaulding Turnpike, Newington, by increasing the amount by $190,000 from $4,010,000.01 to $4,200,000.01.  80% Federal, 20% Highway Funds. 

 

#88          Authorized Bureau of Construction to enter into a contract with L.A  Brochu Inc., Concord, NH, for the landscaping of US 3, Kilton Road and associated areas in Bedford on the basis of a low bid of $165,500.  Effective upon G&C approval through August 31, 2007.  80% Federal, 20% Highway Funds. 

 

#89          Authorized Bureau of Construction to enter into a contract with DeLucca Fence Company Inc., Methuen, MA for guardrail replacement and other incidental work along NH Route 101 west of the intersection with Optical Avenue in Keene, proceeding east to the intersection with NH Route 101A in Milford, on the basis of a low bid of $1,844,594.40.  Effective upon G&C approval through June 22, 2007.  80% Federal, 20% Highway Funds. 

 

#90          Authorized Bureau of Construction to enter into a contract with East Coast Signals Inc., Deerfield, NH, for replacing the existing span wire signal system including new mast arms, control cabinet, fire preemption, pull boxes and conduit at the intersection of NH Route 10, NH Route 199 and Elm Street in Winchester on the basis of a low bid of $116,135.  Effective upon G&C approval through November 17, 2006.  100% Highway Funds.
