The Governor and Council acted as follows:

 

#8            Authorized to amend an agreement with the City of Keene, NH, (previously approved by G&C on 3-10-04, item #4, amended on 5-3-05, item #3), to help municipalities solve development problems, by extending the end date from June 30, 2006 to June 30, 2007.

 

#9            Authorized under the Community Development Block Grant program to amend an agreement with the City of Berlin, NH, (previously approve by G&C on 8-3-05, item #9), to revise the original budget by adding a new line item for “acquisition”, and transferring $106,000 to this line item from the existing “sitework” line item.

 

                                OFFICE OF INFORMATION TECHNOLOGY

The Governor and Council acted as follows:

 

#10          Authorized to pay an unencumbered outstanding invoice from SFY 2005 using SFY 2006 funds.  The vendor, Atlantic Computer Technologies Inc., will be paid $495 for one DCR Data Entry Keyboard that was received by OIT on June 5, 2005 for use by the Department of Transportation.  100% Other Funds. 

 

#11          Authorized to accept the assignment of a contract with Creative Socio-Medics Corp., Islip, NY, from the Department of Health and Human Services (previously approved by G&C on 9-3-03, item #123), for maintenance and support of the Patient Care System.  (2)Further Authorized to accept the assignment of the contract agreement from Creative Socio-Medics Corp. to Netsmart New York Inc., Great River, NY.  (3)Further Authorized to enter into a retroactive contract amendment with Netsmart New York Inc., (previously approved by G&C on 9-3-03, item, #123), by extending the end date from June 30, 2005 to June 30, 2007.  Effective upon G&C approval.  100% Other Funds. 

 

#12          Authorized to enter into a sole source contract with Software House International, Paxton, MA, for software and peripheral services, including support services and maintenance, to sustain day-to-day operational needs of agencies within the State of NH in the amount of $12,047.  Effective upon G&C approval through May 29, 2007.  82.6% Other, 17.4% Federal Funds. 

 

#13          Authorized with Councilor Pignatelli voting no, to accept the assignment of a contract with epixtech, Inc., Provo, UT, from the Department of Cultural Resources for maintenance and support of the NH State Library System.  (2)Further Authorized OIT to accept the assignment of the contract agreement above from epixtech, Inc., to Dynix Corporation, Provo, UT.  Effective upon G&C approval.  (3)Further Authorized to enter into a retroactive sole source contract amendment with Dynix Corporation (previously approved by G&C on 5-15-02, item #46), for maintenance and support of the NH State Library System, by increasing the amount by $363,499.17 from $448,000 to $811,499.17, and by extending the end date from June 30, 2004 to October 31, 2010, and by adding deliverables to section 14.  84.9% Other, 15.1% Federal Funds. 

 

                                OFFICE OF THE ADJUTANT GENERAL

The Governor and Council acted as follows:

 

#14          Authorized Michael C. Parrinello, Spingvale, ME, be confirmed for appointment to the rank of Major, NH Air National Guard.

 

#15          Authorized to accept and expend additional federal funds in the amount of $230,220 from the federal government (National Guard Bureau) as part of the five-year Federal-State Master Cooperative Agreement  to cover the cost of overtime for snow removal and Utility at Pease Air National Guard Base from February 29, 2006 through June 30, 2006.  (2)Further Authorized the federal funds above to be budgeted as detailed in letter dated February 27, 2006, with the funds to be adjusted between Federal and State Fiscal years, if needed and justified, with the approval of the Budget Office, Department of Administrative Services.  (3)Further Authorized comptroller to adjust budgeting of the funds specified above, between federal and State fiscal years, if needed and justified, with approval of the Budget office, Department of Administrative Services.  Effective upon G&C approval through June 30, 2006.  100% Federal Funds.  Fiscal Committee approved. 

 

#16          Authorized to accept and expend additional federal funds in the amount of $57,233 from the federal government (National Guard Bureau) as part of the five-year Federal-State Master Cooperative Agreement in support of the NH Army National Guard Electronic Security Systems Program.  (2)Further Authorized to establish on full-time temporary Electronic Technical I position, salary grade 17, to be located at the State Military Reservation, Concord, NH.  (3)Further Authorized the federal funds above to be budgeted as detailed in letter dated February 24, 2006, with the funds to be adjusted between Federal and State Fiscal years, if needed and justified, with the approval of the Budget Office, Department of Administrative Services.  Effective upon G&C approval through June 30, 2007.  100% Federal Funds.  Fiscal Committee approved. 

 

                                DEPARTMENT OF ADMINISTRATIVE SERVICES

The Governor and Council acted as follows:

 

#17          Authorized a Working Capital Warrant in the amount of $390,000,000 to cover expenditures for the Month of May 2006.  (2)Further Authorized a Working Capital Warrant reporting expenditures of $467,798,620.52 for the Month of March and recommends the balance of $62,201,379.48 be lapsed.

 

#18          Authorized to accept and place on file the list of agency transfers Authorized for Fiscal Year 2006 during the month of March.

 

#19          Authorized Salary Adjustment Fund and Employee Benefit Adjustment Fund and in conformance with the Governor and Council action of February 6, 2005, the agency transfer, as detailed in letter dated April 6, 2006, were Authorized for the month of March.

 

#20          Authorized to accept and place on file the list of vendors that agencies have contracted with for the period of January 1, 2006 through March 31, 2006.

 

#21          Authorized Bureau of General Services to retroactively pay Virgin Construction Corporation, Franklin, NH, $4,980 for emergency catch basin repairs that were performed on Hazen Drive in late December of 2005 and early January of 2006.

 

#22          Authorized Bureau of Risk Management to enter into an agreement with TD Banknorth Insurance Agency, to purchase property insurance for State owned property at a cost of $289,649.  Effective May 1, 2006 through May 1, 2007.

 

#23          Authorized to accept and place on file the Report and Findings of Councilor Raymond J. Wieczorek with regard to a certain proposal for construction, furnishing and equipping of certain facilities and the refinancing of certain existing indebtedness in connection with Southeastern Regional Education Service Center, Inc., Bedford, NH.

 

#24          Authorized to accept and place on file the Report and Findings of Councilor Peter J. Spaulding with regard to the construction, renovation and equipping of certain of the Institution’s facilities and the refinancing of existing debt in connection with Riverbend Community Mental Health Inc., Concord, NH.

 

#25          Authorized to accept and place on file the Report and Finding of Councilor Raymond S. Burton with regard to a certain proposal for the construction, renovation, and equipment project and the refinancing of existing indebtedness in connection with LRGHealthcare, Laconia, NH.

 

#25A      Authorized Bureau of Court Facilities to enter into a one-year lease renewal with an option to extend for an additional year, with the City of Berlin, NH, for space in the District Court.  (2)Further Authorized to test indoor air quality in this facility due to the non-budgeted financial burden imposed on the Town/State to obtain a clean air certificate.  Effective May 1, 2006 through April 30, 2007.

 

#25B       Authorized to enter into a contract with Lawson Software, St. Paul, MN, for the Enterprise Resource Planning Commercial Off-the-Shelf software licenses, maintenance, and support, who in partnership with the Implementation Services will implement a total state-of-the-art ERP solution for the State of NH, at a cost not to exceed $7,517,030.  Effective upon G&C approval through June 30, 2016.

 

#25C       Authorized to enter into a contract with CIBER Inc., Greenwood Village, CO, for the implementation services and software required to implement a total state-of-the-art Enterprise Resource Planning solution, to initially replace existing core financial accounting, budgeting and human resources systems, and take advantage of additional available ERP functionality at a cost not to exceed $13,083,292.  Effective upon G&C approval through June 30, 2009.

 

                                DEPARTMENT OF REVENUE ADMINISTRATION

#26          The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek Authorized the request of retroactive approval for Charles H. Redfern to be hired as Field Audit Leader, Unclassified position #9U328, and be placed at Maximum for Group DD ($65,520) effective March 22, 2006.  100% General Funds. 

 

                                DEPARTMENT OF AGRICULTURE, MARKETS & FOOD

The Governor and Council acted as follows:

 

#27          Authorized to accept and expend funds in the amount of $35,000 from the University of NH, Durham, NH, to assist NHDAMF in the expansion of its computer website to include a section about farm risk management and crop insurance, along with other information technology improvements such as improvement and expansion of its Internet presence (including acquisition of appropriate equipment and software and website management), coordinating/sponsoring two risk management workshops for organic growers, and News Alerts in the Weekly Market Bulletin.  Effective upon G&C approval through December 31, 2007.  100% Other Funds. 

 

#28          Authorized to amend a grant with the US Department of Agriculture Agricultural Marketing Service, Livestock and Seed Program, Seed Regulatory and Testing Branch, (previously approved by G&C on 10-22-03, item #13), in the amount of $5,595 for providing assistance with seed testing and by extending the completion date to September 30, 2007 from September 30, 2005.  100% Federal Funds. 

 

                                TREASURY DEPARTMENT

#29          The Governor and Council on motion of Councilor Burton, seconded by Councilor Spaulding Authorized the request to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $30,319.50 to the rightful owners of abandoned or unclaimed funds.  100% General Funds. 

 

                                DEPARTMENT OF CULTURAL RESOURCES

The Governor and Council acted as follows:

 

#30          Authorized NH Film Commission to enter into a sole source contract with NH Movies, Deerfield, for updating of a promotional video in the amount of $7,000.  Effective upon G&C approval through September 30, 2006.  100% General Funds. 

 

#31          Authorized to award a Conservation Number Plate Grant in the amount of $10,000 to the Town of Plymouth.  Effective upon G&C approval through September 30, 2006.  100% Other Funds.

 

#32          Authorized Division of Historical Resources to amend an agreement with the City of Concord (previously approved by G&C on 8-3-05, item #52), by increasing the amount by $2,000 to an amount not to exceed $12,000 for the Concord Old North Cemetery Project.  Effective upon G&C approval through September 30, 2006.  100% Federal Funds. 

 

                                ATTORNEY GENERAL

#33          The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek Authorized the request to amend a sole source contract with National Medical Services, Willow Grove, PA, to provide toxicology testing services, by increasing the cap from $65,000 to $100,000.  Effective July 1, 2005 through June 30, 2006.  91.5% General, 8.5% Federal Funds. 

 

                                INSURANCE DEPARTMENT

#34          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Spaulding Authorized the request to designate Mr. Tyler Brannen, as a Healthcare Statistician at salary group DD at step 05 ($65,520) effective June 30, 2006.  100% Other Funds. 

 

                                PUBLIC UTILITIES COMMISSION

#35          The Governor and Council on motion of Councilor Burton, seconded by Councilor Spaulding Authorized the request to accept and expend US Department of Transportation grant funds in the amount of $34,656 in support of the DigSafe program in NH.  Effective upon G&C approval through December 31, 2006.  100% Federal Funds. 

 

                                LIQUOR COMMISSION

The Governor and Council acted as follows:

 

#36          Authorized to reclassify position #14280 Payroll Officer II, labor grade 16, to a Supervisor I, labor grade 19.  100% General Funds. 

 

#37          Authorized to reclassify position #14076 Maintenance Mechanic II, salary grade 12 to Plant Maintenance Engineer I, salary grade 17.  100% General Funds. 

 

#38          Authorized to accept and expend a grant totaling $5,000 from the National Alcohol Beverage and Control Association for underage drinking awareness.  Effective upon G&C approval through June 30, 2006.  100% Other Funds. 

 

#39          Authorized to transfer appropriated funds in the amount of $245,700 within and among organizational units of the appropriation warrant dated July 1, 2005, Chapter 176, Laws of 2005, for fiscal year 2006, to compensate for expected shortfalls and to adjust the budget as detailed in letter dated March 9, 2006.  100% General Funds.  Fiscal Committee approved. 

 

                                DEPARTMENT OF CORRECTIONS

The Governor and Council acted as follows:

 

#40          Authorized to enter into a contract with Bio-Medical Applications of NH, Inc., d/b/a NH Kidney Center, Concord, NH, for the provision of Hemodialysis services, in the amount of $2,159,040.  Effective upon G&C approval through May 1, 2008 and with the option to renew for an additional period of up to two years with approval of G&C.  100% General Funds. 

 

#41          Authorized to enter into a contract with Joyce Dental Laboratory, Laconia, NH, for the provision of Dental Laboratory Services in the amount of $100,190.  Effective upon G&C approval through April 4, 2008 and with the option to renew for an additional period of up to two years with approval of G&C.  100% General Funds. 

 

                                FISH AND GAME DEPARTMENT

#42          The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Wieczorek Authorized the request to transfer $200,000 from the NH Fish and Game Fund Reserve to the Fish and Game FY 2006 Operating Budget.  Fiscal Committee approved. 

 

                                DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Council acted as follows:

 

#43          Authorized to assign vehicle D1 on a 24 hour, seven day a week basis to the DRED Commissioner.

 

#44          Authorized to enter into a Cost Sharing Agreement with the NH Fish and Game Department and the County of Coos for costs relating to the operation of the North County of Coos for costs relating to the operation of the North Country Resource Center in Lancaster, NH.

 

#45          Authorized Division of Parks and Recreation to accept and expend a federal grant from the National Park Service, through the Land and Water Conservation Fund for the period ending June 30, 2007 for “State Park Improvement Projects” in the amount of $160,000.  Fiscal Committee approved. 

 

                                DEPARTMENT OF ENVIRONMENTAL SERVICES

The Governor and Council acted as follows:

 

#46          Authorized to accept and expend $33,894 in federal flow through Homeland Security funds from the Department of Safety for the purpose of purchasing equipment and materials for responding to terrorist incidents.  Effective upon G&C approval through March 31, 2007.  100% Other Funds. 

 

#47          Authorized to reclassify position #19530, Principal Planner, labor grade 24 from the Solid Waste Technical Assistance Section to a Program Assistant II, labor grade 15.  100% General Funds. 

 

#48          Authorized to enter into an agreement with the Town of Meredith, NH, in the amount of $50,000 for the Watershed Approach Pilot Program, Lake Waukewan Watershed.  Effective upon G&C approval through July 30, 2008.  100% Federal Funds. 

 

#49          Authorized to approve a loan agreement with the City of Manchester, in the amount of $5,300,000 to finance the construction of the Poor/Schiller Street CSO Separation project.  Effective upon G&C approval.

 

#50          Authorized to approve an Original Loan Agreement with the City of Portsmouth in the amount of $2,000,000 to finance the design of a new surface water treatment facility.  Effective upon G&C approval.  83% Federal, 17% Capital (General) Funds. 

 

#51          Authorized to approve a loan agreement with the City of Manchester in the principal amount of $3,600,000 to finance the Crescent Road CSO Separation.  Effective upon G&C approval.  100% Other Funds. 

 

#52          Authorized to approve a loan agreement with the Town of Troy in the amount of $1,550,000 to finance wastewater system improvements.  Effective upon G&C approval.  100% Other Funds. 

 

#53          Authorized to award grants to the entities as detailed in letter dated April 6, 2006, for purposes of used oil collection.  Effective upon G&C approval through April 19, 2007.  100% Other Funds. 

 

#54          Authorized Ralph & Lois Jury’s Grant of Right request to retain 4,684 sq. ft. of fill and existing house placed in Lake Winnipesaukee in Alton in the 1950’s.

 

#55          Authorized Montgomery Child’s request to construct a platform pier to a ramp to a float providing one undersized slip on frontage on the Cocheco River in Dover.

 

#56          Authorized Chrisopher O’Neill’s request to construct a pier to a ramp to a float providing one undersized slip on frontage on Sagamore Creek in Portsmouth.

 

#57          Authorized Michael Thompson’s request (previously approved by G&C on 11-5-05), to fill, construct breakwater in an “I” configuration with a gap at the shoreline and a cantilevered pier connected to a piling supported dock by a walkway, and install four piles to support a permanent boatlift in the center slip and install a three piling ice cluster on frontage on Rattlesnake Island on Lake Winnipesaukee in Alton.

 

#58          Authorized Jeffrey Gardner’s request to construct a permanent pier on pilings with a ramp to a seasonal float to provide water access on frontage on Berry’s Brook and to remove accumulated debris adjacent to the historic grist mill on site and on the embankment and install plantings of indigenous salt marsh species on Berry’s Brook in Rye.

 

                                DEPARTMENT OF HEALTH AND HUMAN SERVICES

The Governor and Council acted as follows:

#59          Authorized NH Hospital to retroactively continue an increase for recruitment and retention purposes for the Occupational Therapist II and Certified Occupational Therapy Assistant classifications hourly rates by 13.5% as approved by G&C on 9-15-99, item #157, to be effective from November 10, 2001, until the date of G&C approval of #2 as follows.  (2)Further Authorized NH Hospital to continue an increase for recruitment and retention purposes for the Occupational Therapist II and Certified Occupational Therapy Assistant classifications hourly rates by 13.5% as approved by G&C on 9-15-99, item #157, to be effective upon G&C approval through two years.
