The Governor and Executive Council convened at 11:30 a.m. with Councilors Hollingworth, Wieczorek and Pignatelli present in person, Councilor Burton present via telephone, and Councilor Shea was absent.


Governor Lynch read the following statement for Right to Know Compliance:


I would like to ask those councilors participating by telephone to identify themselves and identify anyone else who is physically present with them at the location from which they are participating.


Councilor Hollingworth, Councilor Wieczorek and Councilor Pignatelli were present in person.  Councilor Burton was participating by telephone from his car.  Councilor Burton identified himself and indicated that he was sitting alone in his car in a parking lot.


Second, to comply with the right to know law, I will explain why Councilor Burton’s attendance in person was not reasonably practical.  A special meeting of the Governor and Council to set a date for a special State Senate District 16 election was requested.  Councilor Burton could not physically appear on an expedited basis because of his prior commitments at locations away from the State House; and because the meeting had to be scheduled on very short notice.


                                DEPARTMENT OF STATE

#1           Authorize a special election to be held in State Senate District No. 16.


The Governor and Council, on motion of Councilor Pignatelli, seconded by Councilor Wieczorek, voted to set the date for a special election for State Senate District 16.  A roll call vote of Councilor Burton – yes, Councilor Shea – absent, Councilor Hollingworth – yes, Councilor Wieczorek – yes, and Councilor Pignatelli – yes, was taken.


The filing period will begin on November 30, 2009 and end on December 7, 2009.  The primary election will be January 12, 2010.  The special election will be February 16, 2010.





The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton voted to remove item #69 - which was tabled at the October 21, 2009 Meeting.  With Councilor Hollingworth, and Councilor Pignatelli voting no, the item remains on the table.



                                Division of Public Health Services

#69         TABLED - The Governor and Council on motion of Councilor Burton, seconded by Councilor Wieczorek voted to table the request of the Bureau of Community Health Services, Rural Health and Primary Care Section to enter into an agreement with Performance Management Institute LLC, Portland, ME, to assist rural and underserved stakeholders in developing and sustaining creative, effective access to quality health care services in their rural NH communities in an amount not to exceed $786,000.  Effective October 21, 2009 through August 31, 2011.  100% Federal Funds. 






Next regular Governor and Executive Council meeting is scheduled for Wednesday, December 9, 2009 at 10:00 a.m. at the State House in Concord, New Hampshire.
