                                COMMUNITY DEVELOPMENT FINANCE AUTHORITY

#1A        The Governor and Council on motion of Councilor Spaulding, seconded by Councilor Griffin authorized the request under the Community Development Block Grant program to enter into an agreement with the City of Somersworth, NH for the purpose of rehabilitating 37 units of affordable housing, in the amount of $500,000.  Effective upon G&C approval through December 31, 2007.  100% Federal Funds. 

 

                                OFFICE OF ENERGY AND PLANNING

The Governor and Council acted as follows:

 

#2            Authorized to amend a Fuel Assistance Program agreement with Community Action Program Belknap-Merrimack Counties Inc., Concord, NH, (previously approved by G&C on 9-21-05, item #11, amended on 12-21-05, item #11), by increasing the amount from $2,457,918 by $473,157, to an amount not to exceed $2,931,075.  100% Federal Funds. 

 

#3            Authorized to amend a Fuel Assistance Program agreement with Rockingham Community Action Inc., Portsmouth, NH, (previously approved by G&C on 9-21-05, item #12, amended on 12-21-05, item #10), by increasing the amount from $1,956,464 by $375,055, to an amount not to exceed $2,331,519.  100% Federal Funds. 

 

#4            Authorized to amend a Fuel Assistance Program agreement with Tri-County Community Action Program Inc., Berlin, NH, (previously approved by G&C on 10-5-05, item #1, amended on 12-21-05, item #7), by increasing the amount from $3,301,373 by $638,240, to an amount not to exceed $3,939,613.  100% Federal Funds. 

 

#5            Authorized to amend a Fuel Assistance Program agreement with Strafford County Community Action Committee Inc., Dover, NH, (previously approved by G&C on 9-21-05, item #10, amended on 12-21-05, item #6), by increasing the amount from $1,441,825 by $275,245, to an amount not to exceed $1,717,070.  100% Federal Funds. 

 

#6            Authorized to amend a Fuel Assistance Program agreement with Southern New Hampshire Services Inc., Manchester, NH, (previously approved by G&C on 9-21-05, item #13, amended on 12-21-05, item #9), by increasing the amount from $4,897,027 by $955,510, to an amount not to exceed $5,852,537.  100% Federal Funds. 

 

#7            Authorized to amend a Fuel Assistance Program agreement with Community Southwestern Community Services Inc., Keene, NH, (previously approved by G&C on 9-21-05, item #14, amended on 12-21-05, item #8), by increasing the amount from $1,755,475 by $335,101, to an amount not to exceed $2,090,576.  100% Federal Funds.

The Governor and Council acted as follows:

 

#12          Authorized a Working Capital Warrant in the amount of $730,000,000 to cover expenditures for the month of February 2006.  (2)Further Authorized a Working Capital Warrant reporting expenditures of $540,636,879.01 for the month of December and recommends the balance of $89,363,120.99 be lapsed. 

 

#13          Authorized to accept and place on file the list of agency transfers Authorized for Fiscal Year 2006 during the month of December.

 

#14          Authorized the permanent assignment of an Administrative Services vehicle to the Director of the Bureau of Court Facilities.

 

#15          Authorized the Division of Plant and Property Management to enter into a contract with US Cellular Corporation of Bedford, NH, for Wireless Cellular Services, for a maximum price of $2,500,000.  Effective February 18, 2006 through February 18, 2009.

 

#16          Authorized the Division of Plant and Property Management to enter into a contract with Nextel Communications of the Mid-Atlantic of Bethesda, MD, for Wireless Cellular Services, for a maximum price of $2,500,000.  Effective February 18, 2006 through February 18, 2009.

 

#17          Authorized the Division of Plant and Property Management to enter into a contract with Cellco Partnership d/b/a Verizon Wireless of Bedminster, NJ, for Wireless Cellular Services, for a maximum price of $2,500,000.  Effective February 18, 2006 through February 18, 2009.

 

                                DEPARTMENT OF AGRICULTURE, MARKETS & FOOD

The Governor and Council acted as follows:

 

#18          Authorized Division of Animal Industry to amend G&C item #23 of the 11-2-05 meeting, by reallocating funds in the amount of $16,985 from Class 050 and establishing Class 045 for the best use of funds for the remaining spending authority.  Effective upon G&C approval through March 31, 2006.  100% Federal Funds. 

 

#19          Authorized Division of Animal Industry to accept and expend grant funds from the USDA Animal and Plant Health Inspection Service in the amount of $5,000 to be used to provide financial assistance to the State for Scrapie Disease surveillance, flock certification , education for flock owners and veterinarians, and supporting the fairs in maintaining isolation pens and education to maintain a Scrapie Disease free environment.  Effective upon G&C approval through March 31, 2006.  100% Federal Funds. 

 

#20          Authorized Division of Animal Industry to accept and expend grant funds from the USDA Animal and Plant Health Inspection Service in the amount of $29,000 to be used to provide financial assistance to the state for a Foot and Mouth Disease Swine Feeder Program.  Effective upon G&C approval through March 31, 2006.  100% Federal Funds. 

 

                                TREASURY DEPARTMENT

#21          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Burton authorized the request to issue a warrant from funds not otherwise appropriated and the State Treasurer to issue checks in the amount of $43,950.46 to the rightful owners of abandoned or unclaimed funds.

 

                                CONNECTICUT RIVER VALLEY RESOURCE COMMISSION

#22          The Governor and Council on motion of Councilor Burton, seconded by Councilor Spaulding and with Councilor Pignatelli voting no, authorized the request to enter into a retroactive sole source agreement with the Connecticut River Joint Commissions, Charlestown, NH, to hire the equivalent of one full time staff person, in the amount of $39,285.  Effective July 1, 2005 through June 30, 2006.  100% General Funds. 

 

                                ATTORNEY GENERAL

The Governor and Council acted as follows:

 

#23          Authorized to appoint Stephen G. LaBonte as an Assistant Attorney General, at a salary level of $45,547.  Mr. LaBonte will be occupying a position with a five year term that expires May 21, 2008.

 

#24          Authorized to appoint Anthony I. Blenkinsop as an Assistant Attorney General, at a salary level of $58,000.  Mr. Blenkinsop will be occupying a position with a five year term that expires December 6, 2010.

 

#25          Authorized to reappoint Kim K. Fallon as a Forensic Investigator for a five year term effective retroactive to January 24, 2006 through January 24, 2011.

 

#26          TABLED – The Governor and Councilor on motion of Councilor Spaulding, seconded by Councilor Wieczorek and with Counilor Pignatelli voting no, voted to table the petition of Dale Frederick Gardner requesting a pardon hearing for the offense of Aggravated Felonious Sexual Assault.  The petitioner is not eligible for an annulment.

 

                                PARI-MUTUEL COMMISSION

The Governor and Council acted as follows:

 

#27          Authorized to revise the salaries of its Commission Veterinarians; Greyhound, Harness and Thoroughbred appointed to serve at the various racetracks as detailed in letter dated January 6, 2006.  The amounts coincide with the 2% pay increases that other State Employees will receive effective January 6, 2006 and July 7, 2006. 

 

#28          Authorized to enter into a sole source janitorial service contract with Kang Company Inc., Concord, NH, for an amount not to exceed $8,140.  Effective upon G&C approval through June 30, 2007.  92% General, 8% Other Funds. 

 

                                LIQUOR COMMISSION

The Governor and Council acted as follows:

 

#29          Authorized to assign vehicles to the individuals as detailed in letter dated January 4, 2006, on a 24-hour, 7 days per week basis.  Effective upon G&C approval.

 

#30          Authorized an exemption to NH Purchasing Rules to enable the Liquor Commission to increase its fleet by six vehicles.

 

                                EMPLOYMENT SECURITY

The Governor and Council acted as follows:

 

#31          Authorized to temporarily extend one Grants Program Coordinator position #8T070, salary grade 23 through March 1, 2007.  100% Federal Funds. 

 

#32          Authorized to temporarily extend one Program Specialist I position #8T069, salary grade 19, through February 9, 2007.  100% Federal Funds. 

 

#33          Authorized to extend a lease agreement with Key Road Associates (previously approved by G&C on 4-21-04, item #30), for rental of 4,800 square feet of office space located in Keene for an additional term beginning February 1, 2006 through January 31, 2009, for a total cost of $156,960.  100% Federal Funds. 

 

                                DEPARTMENT OF CORRECTIONS

The Governor and Council acted as follows:

 

#33A      Authorized to accept donations for the period of October 2005 through December 2005 with a total value of $2,132.57.

 

#34          Authorized with Councilor Pignatelli voting no, a retroactive approval in concurrence with the decision of the Director of Personnel dated August 18, 2005 to continue the 20% salary enhancement for position #19851 Chief Pharmacist, labor grade 29 and position #19848, Pharmacist, labor grade 25.  Effective September 19, 2005 through September 18, 2007. 

 

#35          Authorized to enter into a contract with A-1 Fire Protection Inc., d/b/a All State Fire Equipment, Windsor, NH, to provide maintenance, inspection, testing, recharging and repair for portable fire extinguisher and range guard systems, in the amount of $34,176.  Effective March 1, 2006 or upon G&C approval, whichever is later, through February 28, 2008 with an option to renew for one additional period of up to two years upon G&C approval.  100% General Funds. 

 

                                DEPARTMENT OF ENVIRONMENTAL SERVICES

The Governor and Council acted as follows:

 

#36          Authorized to enter into a sole source agreement with the Association of US Delegates to the Gulf of Maine Council, South Portland, ME, to analyze mussel samples from NH’s estuaries for toxic contaminants in the amount of $9,773.  Effective upon G&C approval December 31, 2006.  (2)Further Authorized to award an advance payment in the amount of $9,773 to the Association of US Delegates to the Gulf of Maine Council in accordance with the terms of the agreement.

 

#37          Authorized an Original Loan agreement with the City of Rochester, NH, to finance water system improvements in the amount of $560,000.  Effective upon G&C approval.  83% Federal, 17% General Funds. 

 

#38          Authorized to accept and place on file the 2005 Annual Report of the Water Council.

 

#39          Authorized to enter into a cooperative project agreement with the University of NH, Office of sponsored Research, Durham, NH, for the Great Bay Coast Watch Storm Event Sampling at Berry’s Brook in the amount of $3,780.  Effective upon G&C approval through December 31, 2006.  100% Federal Funds. 

 

#40          Authorized to enter into a cooperative project agreement with the University of NH, Office of Sponsored Research, Durham, NH, for the Pollution Source Identification Study of Berry’s Brook in the amount of $20,000.  Effective upon G&C approval through December 31, 2006.  100% Federal Funds. 

 

#41          Authorized to enter into an agreement with the Town of Exeter, NH, to conduct water resources improvements projects in the amount of $23,445.  Effective upon G&C approval through June 30, 2007.  100% Federal Funds. 

 

                                NH FISH AND GAME DEPARTMENT

The Governor and Council acted as follows:

 

#42          Authorized to amend G&C item #52 from the 8-18-04 meeting, by reallocating funds in the amount of $499,998 for the best use of remaining spending authority.  Effective upon G&C approval through December 31, 2012.  100% Federal Funds. 

 

#43          Authorized to enter into a contract with Holmes Lewis Inc., Concord, NH, for media placement services in the amount of $60,000.  Effective upon G&C approval through June 30, 2007.  100% Fish and Game Funds. 

 

#44          Authorized to enter into a contract with Glen Group Inc., North Conway, NH, to redesign and update an existing website for the hikeSafe educational initiative in the amount of $16,407.40.  Effective upon G&C approval through June 30, 2007.  100% Other Funds. 

 

#45          Authorized to amend a Cooperative Project Agreement with the University of NH, (previously approved by G&C on 1-7-04, tabled item #54), for the purpose of researching marsh bird species of concern by extending the term of the contract from January 31, 2006 to June 30, 2006.

 

#46          Authorized to amend a contract with Fay, Spofford & Thorndike, LLC of Bedford, NH, (previously approved by G&C on 5-18-05, item #35), to provide environmental consulting and engineering services for boat access projects, by increasing in the amount of $50,000 for a total contract of $350,000. 

 

                                DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

The Governor and Council acted as follows:

 

#47          Authorized Design, Development, and Maintenance to amend a sole source contract with Dufresne-Henry Inc., Manchester, NH, to provide additional design and construction management services for the electrical transmission line to the summit of Mt. Washington by increasing the amount by $51,500 from $422,100 to $473,600. 

 

#48          Authorized Division of Forests and Lands to enter into an agreement on a sole source basis with The Nature Conservancy to undertake management measures and outreach activities to maintain and promote protection of NH’s native plant species and natural plant communities for a total of $182,000.  Effective upon G&C approval through March 31, 2007.  100% Other Funds. 

 

#49          Authorized Division of Travel and Tourism Development to award grants under the Joint Promotional Program as detailed in letter dated January 26, 2006.  Effective upon G&C approval.  100% General Funds. 

 

#50          Authorized to accept and place on file the Park Revenue and Expenditures including Cannon Mountain Ski area, for fiscal year 2005.

 

                                OFFICE OF LICENSED ALLIED HEALTH PROFESSIONALS

#51          The Governor and Council on motion of Councilor Burton, seconded by Councilor Spaulding authorized the request to enter into a contract with H&C Commercial Cleaning, Concord, NH, for janitorial services.  Effective upon G&C approval through December 31, 2007.  99% General, 1% Other Funds.

#52          Authorized to grant an annual salary increment to Mary P. Castelli, Senior Division Director, salary group JJ, step 4 ($92,932) to salary group JJ, step 5 ($97,822), effective February 11, 2006.

 

#53          Authorized on behalf of Minority Health to make a single retroactive unencumbered payment of $8,197 to Southern NH Services Incorporated, Manchester, NH, to pay for translation and interpretation services to adults and children served by the Department during the period October 1, 2005 through December 6, 2005.  Effective upon G&C approval.  50% Federal, 50% General Funds. 

 

#54          Authorized Office of Medicaid to make an unencumbered payment to the New England States’ Consortium Systems Organization Shrewsbury, MA, to provide Medicaid technical support services in an amount not to exceed $50,000.  Effective upon G&C approval through June 30, 2007.  100% General Funds.

#55          Authorized  to accept a monetary donation from Episcopal Churchwomen, Church of the Messiah, Woodstock, NH, in the amount of $200, and deposit same into the Patient’s Welfare Fund.

#56          Authorized Bureau of Community Health Services, Rural Health and Primary Care Section to enter into an agreement totaling $20,000 with Glen Adams, DO, Lancaster, NH, to provide services through the physician loan repayment program.  Effective upon G&C approval through June 30, 2007.  100% General Funds. 

 

#57          Authorized with Councilor Pignatelli voting no, the Bureau of Community Health Services, STD/HIV Prevention Section to enter into an agreement totaling $43,260 with The UJIMA Collective, Manchester, NH, to provide Human Immunodeficiency Virus prevention services.  Effective retroactive to July 1, 2005 through June 30, 2006.  100% Federal Funds. 

 

#58          Authorized Bureau of Community Health Services, Rural Health and Primary Care Section to enter into an agreement totaling $20,000 with John Lloyd, MD, Hebron, NH, to provide services through the physician loan repayment program.  Effective upon G&C approval through June 30, 2007.  100% General Funds.

#64          Authorized to grant sole source funds to the Alliance for Community Supports, Manchester, NH, for $1,227,457.44, to provide training and service to those who are supporting educationally disabled students who are at risk of school dropout.  Effective upon G&C approval through December 31, 2008.  (2)Further Authorized unencumbered payment of said grants with internal accounting control.  100% Federal Funds. 

 

#65          Authorized to enter into a sole source contract with Kyran Research Associates Inc., Middletown, RI, for maintenance and enhancements to the existing Vocational Rehabilitation case management system in an amount not to exceed $800,000.  Effective upon G&C approval through December 30, 2010.  (2)Further Authorized payment for services rendered and approved in lieu of withholding at least 25% of the total value of the contract.  100% Federal Funds. 

 

                                NH POSTSECONDARY EDUCATION COMMISSION

#66          The Governor and Council on motion of Councilor Wieczorek, seconded by Councilor Pignatelli authorized the request to award a $17,500 grant to Franklin Pierce College for the purpose of granting scholarships to NH residents who have completed their freshman year and who will be selected for scholarships by the college on the basis of financial need or merit.  Effective upon G&C approval through June 30, 2006.  100% General Funds.

#67          Authorized Division of Fire Standards and Training and EMS to reclassify vacant position #41979 from a Building Service Worker II, labor grade 5, to a Maintenance Mechanic I, labor grade 8.  Effective upon G&C approval.  100% Fire & EMS Funds. 

 

#68          Authorized Division of Motor Vehicles to accept and expend a $12,089 grant entitled “DMV School Bus Enforcement” from the NH Highway Safety Agency.  Effective upon G&C approval through September 15, 2006.

#80          Authorized Bureau of Right of Way to enter into contracts with nineteen appraisal firms to prepare appraisals for property needed for transportation projects for a total cost not to exceed $3,000,000.  Effective upon G&C approval through January 11, 2009.

 

#81          Authorized Bureau of Right of Way to quitclaim to the NH Fish and Game Department whatever interest the Department of Transportation may have in a 0.57 acre parcel of State owned land located in the Town of Hampton.  (2)Further Authorized to accept a transfer of a 0.57 acre parcel of land in the Town of Hampton, NH, from the Department of Transportation, at no cost to the NH Fish and Game Department.  Effective upon G&C approval.
