BOARD OF AUCTIONEERS MINUTES

Legislative Office Building Room 307, Concord, NH

July 9, 2012, 9:00 a.m.

 

1.         The Board of Auctioneers convened at 9:00 a.m. with, Chairperson Frank L. Eaton, Vice-Chairperson Russell R. Abbott, Member Richard C. Berman, and Member Gregory J. Walsh present.  Secretary Roy W. Tilsley was absent.

 

2.         The Board on motion of Richard C. Berman, seconded by, Russell R. Abbott accepted the minutes of the June 4, 2012 meeting.

 

3.         The Board on motion of Gregory J. Walsh, seconded by Richard C. Berman, authorized the application of Deborah Peverly for an Auctioneers License.

 

4.         The Board on motion of Gregory J. Walsh, seconded by Richard C. Berman, and further on a roll call vote as follows: Frank L. Eaton – yes, Richard C. Berman – yes, Russell R. Abbott – yes, Roy W. Tilsley – absent, and Gregory J. Walsh – yes, voted to go into non-public session to discuss matters under RSA 91-A, specifically, matters which would likely adversely affect the privacy of individuals and or matters in which litigation has been threatened against the Board.

 

5.         The Board on motion of Gregory J. Walsh, seconded by Richard C. Berman voted to come out of non-public session.

 

6.         The Board on motion of Gregory J. Walsh, seconded by Richard C. Berman, voted to appoint an investigator / prosecutor for the complaint made by Edward Inguaggiato. 

 

            The Board on motion of Gregory J. Walsh, seconded by Richard C. Berman voted to appoint Russell R. Abbott as investigator / prosecutor for the complaint made by Edward Inguaggiato.

 

7.         The Board discussed rules.

 

8.         Further Business:

 

A.     June 15, 2012 article in the WheelsNH – Union Leader, for Dingman Car Auction held in June, did not appear to have a NH licensed auctioneer held accountable for the auction, and the company is not registered to do business in NH.

 

The Board on motion of Richard C. Berman, seconded by Gregory J. Walsh, voted to appoint an investigator / prosecutor.

 

The Board on motion of Russell R. Abbott, seconded by Gregory J. Walsh voted to appoint Frank L. Eaton as investigator / prosecutor.

 

B.     June 28, 2012 advertisement in the Union Leader for Farnese Construction Inc., Auction held July 7, 2012, listed James Horne as the licensed Auctioneer of Record, but was not present for the auction.  A show cause hearing notice will be sent for the August 13, 2012 Board meeting.

 

 

 

C.     AuctionZip – unlawful activity letters that have been sent for unlicensed individuals or unregistered businesses will be resent via certified mail.  If unresolved within 10 business days of receipt of the letter, the individual or business will receive a certified show cause hearing notice.  Penalties and fines will apply. 

 

9.         The Board on motion of Richard C. Berman seconded by Gregory J. Walsh then Adjourned at 10:30 a.m.

 

 

 

The next scheduled monthly meeting will be held August 13, 2012

at the Legislative Office Building, Room 307, Concord, New Hampshire.
